The vetting process is largely incomplete; the strategy for trials is unknown; the reparations budget is postponed. And there seems to be no political will at the president\u2019s office.<\/strong><\/p>\n\n\n\n<!--more-->\n\n\n\n<p>When Gambia\u2019s <a href=\"https:\/\/www.justiceinfo.net\/en\/41754-time-for-the-truth-in-gambia.html\">Truth, Reconciliation and Reparations Commission (TRRC)<\/a> wrapped up in November last year, its end was greeted with excitement and hope for a much-awaited second part of the post-dictatorship justice response, mostly criminal justice and reparations. Which meant implementing the <a href=\"https:\/\/www.justiceinfo.net\/en\/86069-trrc-final-report-gambia-between-prosecutions-and-amnesties.html\">TRRC key recommendations<\/a>.<\/p>\n\n\n\n<p>\u201cWe executed our mandate almost flawlessly and submitted our final report and recommendations to the government, and we closed shop,\u201d said Commission\u2019s former executive secretary Dr. Baba Galleh Jallow, looking back on their work.<\/p>\n\n\n\n<p>The TRRC <a href=\"https:\/\/www.justiceinfo.net\/en\/84749-gambia-truth-commission-report-hangs-on-election-result.html\">inquiry<\/a> has found former dictator Yahya Jammeh directly and indirectly responsible for arbitrarily killing of at least 232 people. One of those victims was Jammeh\u2019s own cousin Haruna Jammeh, the father of Isatou Jammeh. Haruna Jammeh was killed by the former leader\u2019s hit-squad called \u201cJunglers\u201d, according to one of its members Omar Jallow, who <a href=\"https:\/\/www.justiceinfo.net\/wp-content\/uploads\/Volume-8-The-Junglers-Unlawful-Killings-Tortures-and-Other-Human-Rights-Violations.pdf\">confessed<\/a> before the Truth Commission in June 2019 to have <a href=\"https:\/\/foroyaa.net\/jungler-admits-participating-in-killing-of-two-gambian-americans\/\">participated<\/a> in the execution. But like many other victims, Isatou Jammeh said the \u201cexcitement that greeted the TRRC\u2019s work has faded\u201d.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">No government implementation plan<\/h2>\n\n\n\n<p>It has been 10 months\u2014from November 25 to now\u2014since Gambian president Adama Barrow received the TRRC final report on human rights violations under the Jammeh, and nine since he officially accepted it. In May <a href=\"https:\/\/www.justiceinfo.net\/en\/92890-gambia-validates-truth-commission-work-and-promises-justice.html\">the government issued a white paper accepting all but two of the Commission\u2019s 265 recommendations<\/a>. The Justice minister Dawda Jallow promised action would be taken on Jammeh-era crimes, announcing that letters had already been drafted to officials recommended to be sacked or banned by the Commission for involvement in human rights abuses.<\/p>\n\n\n\n<p>But four months after the promise, n<a href=\"https:\/\/www.justiceinfo.net\/en\/105987-gambia-suspect-officials-remain-government-stalls-trc-recommendations.html\">one of the officials have been fired<\/a>. Those who should have been banned from holding public office continue to work or are sent on administrative leave.<\/p>\n\n\n\n<p>\u201cEvery time you have them at workshops, they say the same things. We are tired of hearing what the Ministry (of Justice) intends to do. Let us see these things so that we can believe something is going on,\u201d said Isatou Jammeh.<\/p>\n\n\n\n<p>The implementation of the recommendations of the TRRC \u2014 as envisaged by the former Justice minister Abubakarr Tambadou \u2014 is to be monitored by the National Human Rights Commission. The problem though, according to the rights commission\u2019s chair Emmanuel Joof, is that \u201cthe government is yet to come up with an implementation plan,\u201d that they could use as a checklist.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Lack of political will?<\/h2>\n\n\n\n<p>The relationship between President Barrow and the Jammeh\u2019s victims has been a tough one. Quite often Barrow chose political expediency over justice. One such case was his attempt to forge an alliance with Jammeh ahead of the 2021 presidential elections\u2014an attempt refused by the exiled autocratic ruler but accepted by the leadership of his party.<\/p>\n\n\n\n<p>On September 22, Barrow faced Gambian lawmakers for his \u2018state of the nation\u2019 address. The televised address is expected to reveal his legislative and policy plans for the coming year. He had one sentence to say about the TRRC. \u201cFollowing the submission of the TRRC report last year, Cabinet approved the relevant Government White Paper in May 2022 for implementation,\u201d said Barrow. No word on justice for Jammeh-era crimes. No word on reparations. No word of any efforts being made to actually implement the recommendations.<\/p>\n\n\n\n<p>And the person who welcomed him into the parliament \u2013 the House leader and the third most powerful political official in the country \u2013 was Fabakary Tombong Jatta, Jammeh\u2019s longest serving majority leader in the parliament who, until recently, had campaigned for <a href=\"https:\/\/www.justiceinfo.net\/en\/81884-gambia-truth-commissions-final-report-binned.html\">the TRRC report to be binned<\/a>. Unsurprisingly his appointment by Barrow was criticized by the victims.<\/p>\n\n\n\n<p>\u201cThere\u2019s absolutely no political will otherwise it would not have taken nine months since submission of final report and 4 months since the white paper was issued \u2013 and still there\u2019s no action or direction,\u201d said Gambia\u2019s leading rights activist Madi Jobarteh. \u201cAll we hear is the Minister of Justice lamenting the lack of capacity and resources and that the reparations bill will come in 2023.\u201d<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">\u201cNo money\u201d<\/h2>\n\n\n\n<p>At this point, the Ministry of Justice has also failed to produce a prosecution strategy or even decide on a model of a court to handle serious crimes cases. Everything, except the \u201cselective implementation\u201d of the Commission\u2019s recommendations on the sacking and banning of public officials, is stalled.<\/p>\n\n\n\n<p>Following a \u2018Never Again\u2019 march by victims in October 2021, the Ministry of Justice issued a <a href=\"https:\/\/gainako.com\/moj-government-to-allocate-d150-million-to-victims-in-2022-budget\/\">statement<\/a> promising to budget D150 million (about 3 million dollars), for the implementation of the TRRC recommendations for 2022. It didn\u2019t come through. Instead, Jallow confirmed to the human rights committee of the National Assembly in June that they have no money to <a href=\"https:\/\/thepoint.gm\/africa\/gambia\/headlines\/no-resources-to-implement-trrc-recommendations-this-year\">implement<\/a> the recommendations for this fiscal year.<\/p>\n\n\n\n<p>\u201cMany of these recommendations require only simple reforms that do not require much money, if at all,\u201d said former lead counsel of the TRRC Essa Faal. \u201cThese low-hanging fruits could be harvested. Such steps will show commitment and will reinforce the hopes and aspirations of many Gambians for justice in this matter. That could be a good start.\u201d<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Delayed reparations bill<\/h2>\n\n\n\n<p>After the sale of the assets of Jammeh, who lives in Equatorial Guinea, the Gambia government promised to pay D100 million (1,8 million dollars) to the TRRC reparations fund. Only D50 million were paid. In addition to this, Tambadou <a href=\"https:\/\/foroyaa.net\/senegalese-donated-funds-targeted-for-victims-healthcare\/\">announced in August 2019<\/a> that Senegal had contributed D50 million to the TRRC Trust Fund. According to a source who got direct knowledge of the donation this money was from proceeds of the sale of over 2000 tons of Senegalese timber confiscated in the Gambia. When sold by the Gambian authorities, they sent D50 million to Senegal in December 2019, which were returned as Senegal\u2019s contribution to the TRRC.<\/p>\n\n\n\n<p>But it isn\u2019t clear where the donation money went. \u201cThe timber sale was not yet completed at the time and the government decided to give out the D50 million from the Jammeh assets. Meaning that Senegal\u2019s donation is still outstanding,\u201d claimed a senior official of the Justice Ministry who does not want to be named.<\/p>\n\n\n\n<p>By July 2021, the Truth commission has already paid a significant amount of reparations from the D50 million it had received. <a href=\"https:\/\/www.justiceinfo.net\/en\/80683-gambia-truth-commission-price-reparations.html\">The TRRC full reparations assessment<\/a> would require a pay-out of little over US$4 million, TRRC chairman Lamin Sise and his deputy Adelaide Sosseh said in a press conference on July 16, 2021.&nbsp;This leaves a revenue shortfall of US$3.3 million,&nbsp;including US$625,610 to be paid to families of West African migrants killed in Gambia in 2005.&nbsp;However, the government said it is working on a <a href=\"https:\/\/standard.gm\/victims-compensation-bill-to-be-tabled-next-year\/\">reparation bill<\/a> to be tabled next year that will take care of the remaining reparations.<\/p>\n\n\n\n<p>\u201cThe Ministry of Justice should have done a capacity assessment to determine what technical capacities are required for investigations, prosecutions, reparations, and other aspects of the implementation process,\u201d said Jobarteh. \u201cThey should cost the entire TRRC recommendations so that there\u2019s an indicative figure.
