Beth van Schaack<\/a> is the United States Ambassador-at-Large for Global Criminal Justice and she is the guest of Asymmetrical Haircuts, our podcast partner. She describes the US new commitment towards the International Criminal Court<\/a>, including through diplomatic support, information sharing, and donations to the trust fund for victims. She discusses the unique dynamics created by the war in Ukraine<\/a>. \u201cWe\u2019ve never seen the international community this united around the imperative of justice since the Nuremberg era and maybe the 1990s,\u201d she says. \u201cThe key now is one of coordination.\u201d While discussing the different models for the prosecution of the crime of aggression in Ukraine, she says: \u201cNobody wants to repeat the experiment of the Special Tribunal for Lebanon\u201d, that is to build an entire institution upfront and wait years before it can act on an individual in custody. Her preference, while not being too specific, goes to a hybrid tribunal with a sequenced approach.<\/strong><\/p>\n\n\n\n

As a consequence of the war in Ukraine, she also explains how the U.S. Congress has now made it possible to prosecute perpetrators of war crimes that are not citizens but find themselves on U.S. soil. \u201cIt took the conflict in Ukraine to really shed a light on the practical impact of this gap in our law,\u201d she says while acknowledging that \u201ca gap that still exists involves crimes against humanity.\u201d<\/strong><\/p>\n\n\n\n\n\n\n\n
