She describes the US new commitment towards the <a href=\"https:\/\/www.justiceinfo.net\/en\/tribunals\/icc\">International Criminal Court<\/a>, including through diplomatic support, information sharing, and donations to the trust fund for victims. Even though the red lines on Palestine and on Afghanistan remain.<\/strong><\/p>\n\n\n\n<p><strong>She discusses the unique dynamics created by the <a href=\"https:\/\/www.justiceinfo.net\/en\/justice-in-ukraine\">war in Ukraine<\/a>. \u201cWe\u2019ve never seen the international community this united around the imperative of justice since the Nuremberg era and maybe the 1990s,\u201d she says. \u201cThe key now is one of coordination.\u201d While discussing the different models for the prosecution of the crime of aggression in Ukraine, she says: \u201cNobody wants to repeat the experiment of the Special Tribunal for Lebanon\u201d, that is to build an entire institution upfront and wait years before it can act on an individual in custody. Her preference, while not being too specific, goes to a hybrid tribunal with a sequenced approach.<\/strong><\/p>\n\n\n\n<p><strong>As a consequence of the war in Ukraine, she also explains how the U.S. Congress has now made it possible to prosecute perpetrators of war crimes that are not citizens but find themselves on U.S. soil. \u201cIt took the conflict in Ukraine to really shed a light on the practical impact of this gap in our law,\u201d she says while acknowledging that \u201ca gap that still exists involves crimes against humanity.\u201d<\/strong><\/p>\n\n\n\n<!--more-->\n\n\n\n<iframe loading=\"lazy\" src=\"https:\/\/player.blubrry.com\/id\/93404935?cache=1674816890#darkOrLight-Light&shownotes-ffffff&download-ffffff&subscribe-ffffff&share-382e2c&shownotesBackground-ffc72c&downloadBackground-382e2c&subscribeBackground-9b9593&shareBackground-ffffff\" title=\"Blubrry Podcast Player\" scrolling=\"no\" width=\"100%\" height=\"150px\" frameborder=\"0\"><\/iframe>\n\n\n\n<p>We all saw her around at the Assembly of the States Parties of the International Criminal Court last December, friend of the pod Beth van Schaack now gives us a clearer idea of the state of the United States\u2019 relationship with the ICC. Beth is serving as the United States Ambassador-at-Large for Global Criminal Justice and she gives us a 360-degree view of her work with the ICC, in Ukraine, and in other situations worth monitoring.\u00a0\u00a0<\/p>\n\n\n\n<p>On the ICC front, Beth hopes to see a new commitment from the US to diplomatic support, information sharing, and donations to the trust fund for victims. Victims\u2019 support and witnesses\u2019 protection are some of her priorities, \u201cWitnesses are the soft underbelly of the system of international justice\u201d, she says.<\/p>\n\n\n\n<p>We also ask Beth about the special tribunal for the crime of aggression in Ukraine. And we go into details of her preferred model, a hybrid tribunal with a sequenced approach, that can supplement the coordinated effort already in place.&nbsp;<\/p>\n\n\n\n<p>And we get good news on the US domestic front. As a consequence of the war in Ukraine, Congress has made it possible to prosecute perpetrators of war crimes that are not citizens but find themselves on US soil.<\/p>\n\n\n\n<p>Lots of food for future conversations, as Beth shares her thoughts and work on justice for Liberia, Ethiopia, El Salvador, Central African Republic, The Gambia, and South Sudan. Quite a journey.
