It has the trappings of some of the Hague courts \u2013 judges, officials and witnesses \u2013&nbsp;and deals with high-profile cases, like the next known that is due to hear, <\/strong><a href=\"https:\/\/peoplestribunal.net\/resources\/ipt-2024-primer\/\"><strong>on May 16-17<\/strong><\/a><strong>, the Filipino People war crimes\u2019 claims against the US Government and the Marcos and Duterte regimes. But it has no authority and has not been set up by any treaty nor by any state.&nbsp;So, what purpose does a people\u2019s tribunal serve?<\/strong><\/p>\n\n\n\n<!--more-->\n\n\n\n<p>In the Hague, the city of international law, in a room with beautiful 18th-century high stucco ceilings, surrounded by gilt mirrors and tall windows, a group of three berobed \u2018judges\u2019 take their places on a dais and listen while a \u2018registrar\u2019 also in court robes <a href=\"https:\/\/apnews.com\/article\/putin-international-criminal-court-netherlands-crime-bb0a20256019057da42e887542676c7b\">calls the case against Vladimir Putin<\/a> for aggression against Ukraine.&nbsp;<\/p>\n\n\n\n<p>Geoffrey Nice KC is best known as the prosecutor of former president of Serbia Slobodan Milosevic at the <a href=\"https:\/\/www.justiceinfo.net\/en\/tribunals\/icty\">International Criminal Tribunal for the former Yugoslavia (ICTY)<\/a>. He tells Justice Info how he was gradually convinced by the concept of people\u2019s tribunals. \u201cYou just have a right to do it as a citizen of the world. Nation states and international obligations leave undone many, many things that the ordinary public probably think should be done,\u201d says Nice. \u201cWe can do that which the international community is not doing.\u201d&nbsp;<\/p>\n\n\n\n<p>The list of judgments of the <a href=\"https:\/\/permanentpeoplestribunal.org\/all-judgments\/?lang=en\">Permanent People\u2019s Tribunal<\/a> which has been going for more than 40 years, spans several continents and all the major hot-button issues including liberation struggles, environmental crimes and human rights violations.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-a-kangaroo-court\">A \u201ckangaroo court\u201d?<\/h2>\n\n\n\n<p>\u201cThe choice for people\u2019s tribunal is a little bit controversial\u201d, recognises Jasmijn de Zeeuw, a legal advisor at the Dutch NGO Free Press Unlimited. Her organisation was one of those behind the creation of the <a href=\"https:\/\/www.freepressunlimited.org\/en\/current\/inspiring-opening-hearing-peoples-tribunal-murder-journalists\">People\u2019s Tribunal on the Murder of Journalists<\/a>, held in The Hague in 2021-2022. She was at first hesitant because it could be criticised as lacking legitimacy and seen as a \u201ckangaroo court\u201d. But to her it was the right choice because it is \u201ca way of calling for action in cases where so little was being done, that it was kind of a last resort\u201d.<\/p>\n\n\n\n<p>Shadi Sadr, an Iranian human rights lawyer and a PhD candidate at Leiden University, has been involved in several people\u2019s tribunals. The Iranian human rights activist has seen how the ones that discussed rights violations in her country <a href=\"https:\/\/irantribunal.com\/\">- the Iran Tribunal<\/a> and <a href=\"https:\/\/abantribunal.com\/\">the Aban Tribunal<\/a> enabled \u201cNGOs, survivors, victims\u201d to shake off the easily-applied label by the regime in Tehran of \u201copposition\u201d and \u201chaving a political agenda\u201d and instead, their cases are strengthened by engaging with \u201ca group of internationally renowned lawyers who have nothing to do with the case of Iran\u201d. \u201cThey are neutral, independent, impartial,\u201d she says of the judges. That makes \u201cdiscrediting their judgement difficult,\u201d she says. \u201cThen the credibility of the judgement can help NGOs or survivors or victims community to push the international community to take meaningful steps and measures, like justice and accountability.\u201d<\/p>\n\n\n\n<p>But do they achieve that larger goal? De Zeeuw says the journalists\u2019 tribunal has led to further \u201cpositive outcomes\u201d: \u201cFor example, the evidence that was collected in the Sri Lanka case was requested by the UN Human Rights Office. In Mexico, we\u2019re really hoping that the evidence of the tribunal and the testimonies that were deposited will actually be used by the federal prosecutor to start cases&nbsp;and we are currently working with a collective of family members to continue these efforts. Syria is, of course, a bit of a harder case&nbsp;but the evidence, collected by the SCMP [the Syrian Center for Media and Freedom of Expression, lead by <a href=\"https:\/\/www.asymmetricalhaircuts.com\/episodes\/episode-100-building-a-universal-jurisdiction-movement-with-mazen-darwish\/\">Mazen Darwish<\/a>] continues to be brought to the attention of relevant bodies\u201d.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-to-show-that-the-problem-is-political-will\">\u201cTo show that the problem is political will\u201d <\/h2>\n\n\n\n<p>But what makes a people\u2019s tribunal a people\u2019s tribunal? The classic definition <a href=\"https:\/\/www.cambridge.org\/core\/books\/peoples-tribunals-and-international-law\/2B3A57F5E2A6536DF73C7E68E59C347C\">by academics<\/a> who took a close look at the ones from the middle of the 20<sup>th<\/sup> century onwards is: \u201cA civil society initiative establishing a forum for a body of eminent persons and\/or experts to consider allegations of violations of specific standards of international law \u2026in the light of documentary and other forms of evidence presented to them in formal proceedings.\u201d<\/p>\n\n\n\n<p>They can be diverse, not only focusing on human rights but also issues such as environmental problems and the role of international organisations. States generally have the monopoly on prosecuting serious human rights violations - unless they delegate that to an international court such as the <a href=\"https:\/\/www.justiceinfo.net\/en\/tribunals\/icc\">International Criminal Court (ICC)<\/a>. Sovereignty though can act as a shield preventing victims\u2019 access to justice or trying to mould a set of events to fit the official narrative.&nbsp;<\/p>\n\n\n\n<p>\u201cWe thought the form of a people\u2019s tribunal is very interesting, because often in these cases, states use the argument that it\u2019s not possible to organise a hearing or to collect the evidence,\u201d says de Zeeuw. \u201cWe wanted to show actually, by doing it ourselves, that the problem is political will and not the fact that this evidence isn\u2019t available\u201d.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-more-than-50-judgments\">More than 50 judgments<\/h2>\n\n\n\n<p>The fact that there are so many - the Permanent People\u2019s Tribunal lists more than 50 judgments, and it\u2019s not exhaustive - shows that NGOs and activists perceive a real need and that there is a gap in the current, less than perfect system of international justice.<br><br>And then there\u2019s the copycat effect: \u201cTo some extent they breed others,\u201d suggests Nice, \u201cPeople hear about them and think, well, that\u2019s a good idea\u201d. Indeed, Sadr was&nbsp;\u201cso inspired\u201d by the \u201cexperience and also the evidence\u201d in the Iran Tribunal that she helped set up another in its wake - the Aban Tribunal.<\/p>\n\n\n\n<p>For legitimacy, the detail of how the tribunals are both set up and run matters. Who sets them up - are they self-appointed single-issue, undemocratic zealots who are determined to have one result only from their \u2018People\u2019s Tribunal\u2019, to wave at the media as evidence of wrongdoing by the powerful? Or are they accountable also for their actions?&nbsp;<\/p>\n\n\n\n<p>At the Aban Tribunal, Sadr says they were especially \u201ccareful of creating a Chinese Wall between the organisers and the judges\u201d so that the judges\u2019 opinions would not be influenced by the activists.&nbsp;\u201cWe looked for evidence favourable to the other side. So that it wasn\u2019t a sort of show trial. We applied the absolutely strict standard of proof beyond reasonable doubt,\u201d says Nice of the China and Uyghur Tribunals which he chaired.<\/p>\n\n\n\n<p>For the journalists\u2019 tribunal, de Zeeuw says they worked hard at\u00a0finding \u201ca good balance between using the kind of legitimacy that comes with organising it as a court and at the same time building in the safeguards that make sure that you don\u2019t make a mockery of the judicial process\u201d. One thing was having \u201can independent body selecting the judges\u201d. \u201cAnother choice that we made was not to indict individuals, but instead indict states. That way you also avoid this kind of farce of having a defence counsel defending individuals that cannot actually consult with them. We also invited the states to defend themselves if they wanted to,\u201d she says. Even then, respondents rarely - if ever - appear at any of these tribunals which does leave them exposed to a critique of perceived bias and politicisation.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-they-are-not-courts-they-are-people\">\u201cThey are not courts, they are people\u201d<\/h2>\n\n\n\n<p>To counter that, De Zeeuw thinks transparency is the key. \u201cWe did everything in public,\" echoes Nice of the very high-profile people's tribunals he has worked with. \u201cAll the written materials are available\u201d. In addition, among \u201cthe members of the tribunal, everyone was unpaid,\u201d he said. But the balance, says De Zeeuw is keeping it \u201cboth legitimate, but also within the boundaries of what\u2019s acceptable if you\u2019re not an official court.\u201d<\/p>\n\n\n\n<p>Nice says they shied away of being overly legalistic. \u201cThe only legal word we tended to use is the word \u2018Judgment\u2019. There is an important reason for using the word \u2018judgment\u2019. It\u2019s the same form of the word that is in a judicial judgement. But this is the judgment of human beings.\u201d And he is especially critical of tribunals that have the external trappings of a court.<\/p>\n\n\n\n<p>\u201cThere are still tribunals of the kind that turn up wearing robes. And calling themselves judges and all that sort of thing. They\u2019re not real courts. They are people. That\u2019s what\u2019s in the title. It may seem trivial, but it\u2019s actually very, very important conceptually. A robe suggests that you\u2019re carrying the authority of&nbsp;a&nbsp;state&nbsp;or of a body like the UN which have powers to imprison people or apply other sanctions once they reach judgments,\u201d he says.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-i-am-not-concerned-with-success\">\u201cI am not concerned with success\u201d<\/h2>\n\n\n\n<p>It\u2019s difficult to assess the real legacy of people\u2019s tribunals. Nice disavows any concern with legacy on the part of the judges. Rather, he says, \u201cthe legacy is the legacy of those who\u2019ve used the evidence and the judgment to have an effect\u201d.<\/p>\n\n\n\n<p>For De Zeeuw, it was important to \u201cshow that it is possible to gather evidence of responsibility for journalist\u2019s murders if you just put the political will and the capacity and the energy behind it.\u201d In fact, in the part of that tribunal devoted to the death of a Mexican journalist \u201ca lot of witnesses, including the family who were speaking out for the first time, hadn\u2019t even given evidence to the federal prosecutor yet on the case, because on the lack of trust in these state institutions\u201d, she says. But \u201cbecause they did it, a lot of other families in Veracruz organised afterwards in a collective to together speak out about these cases, also realising that they were much stronger if they do it together.\u201d<\/p>\n\n\n\n<p>\u201cI\u2019m not concerned with success because that would make me an activist, wouldn\u2019t it? Assessing \u2018success\u2019 lies with what activists may achieve by use of the judgment,\u201d Nice says. And as for what happens to mountains of evidence? \u201cIt\u2019s there in the public sphere. It is for others to make use of.
