The institution faces pressures on multiple fronts, externally and internally. Evidence of Israeli and American threats against the ICC prosecutor has been made public. It is in this context that allegations of sexual harassment by Karim Khan have now surfaced.<\/strong><\/p>\n\n\n\n<!--more-->\n\n\n\n<p>When state members of the <a href=\"https:\/\/asp.icc-cpi.int\/sites\/asp\/files\/asp_docs\/ASP19\/ICC-ASP-19-INF2-Add3-ENG-CEP-additional-appraisals.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">International Criminal Court (ICC)<\/a> were looking for a new leader of the office of the prosecutor four years ago, their initial list of candidates failed to inspire and there were multiple rounds of consultations which failed to build consensus around one person. Karim Kahn was only on the second, back up,&nbsp;list. The appraisers <a href=\"https:\/\/asp.icc-cpi.int\/sites\/asp\/files\/asp_docs\/ASP19\/ICC-ASP-19-INF2-Add3-ENG-CEP-additional-appraisals.pdf\">provided this rating<\/a>: \u201cMr. Khan is a charismatic and articulate communicator who is well aware of his achievements.\u201d They pointed out the drawbacks of having someone previously working as defence counsel before the court and were irritated by \u201can apparently coordinated write-in campaign by civil society organizations\u201d on his behalf. In February 2021 he was duly elected.&nbsp;<\/p>\n\n\n\n<p>Now, as the court prepares for its annual December budget-setting meeting with its state members, the cracks are showing. The <a href=\"https:\/\/www.justiceinfo.net\/en\/132173-behind-the-scenes-the-icc-prosecutor-coup-declat.html\">investigation into the Israel-Palestine conflict<\/a> has positioned the court in the forefront of world politics. The institution faces pressures on multiple fronts, externally and internally. And court supporters wonder if states will step up to protect the institution they negotiated in 1998.\u00a0<\/p>\n\n\n\n<p>Earlier this month, <a href=\"https:\/\/www.prakkendoliveira.nl\/en\/news\/2024\/criminal-complaint-filed-for-impeding-and-influencing-icc-investigation-into-palestine\" target=\"_blank\" rel=\"noreferrer noopener\">20 Palestinians \u201cfiled a criminal complaint<\/a> with the Dutch Office of the Public Prosecutor (<em>Openbaar Ministerie<\/em>) for impeding and influencing the ICC investigation into the \u2018<a href=\"https:\/\/www.icc-cpi.int\/palestine\" target=\"_blank\" rel=\"noreferrer noopener\">Situation in the State of Palestine<\/a>\u2019 and the harassment, intimidation, pressuring and defamation of ICC staff, including the ICC prosecutor, in the course of this investigation\u201d. The lawyers base the complaint <a href=\"https:\/\/www.theguardian.com\/world\/article\/2024\/may\/28\/spying-hacking-intimidation-israel-war-icc-exposed\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">on journalist investigations<\/a> into a campaign of intimidation by Israeli intelligence services against Karim Khan\u2019s predecessor Fatou Bensouda. They say \u2013 based on that media work \u2013 that \u201cthe Dutch investigation should focus on (senior) members of the Israeli security apparatus\u201d. According to Danya Chaikel, the International Federation of Human Rights\u2019 representative to the court, \u201cdiplomacy alone clearly won\u2019t solve this, and legal action is needed to hold those responsible accountable and to safeguard the integrity of the Court\u201d.<\/p>\n\n\n\n<p>The Dutch <a href=\"https:\/\/www.opensocietyfoundations.org\/newsroom\/threats-against-palestinian-lawyer-over-icc-work-must-end\" target=\"_blank\" rel=\"noreferrer noopener\">did open an investigation<\/a> back in 2016 and provided protection measures for representative from <a href=\"https:\/\/www.fidh.org\/en\/issues\/human-rights-defenders\/attacks-against-al-haq-s-representative-in-europe-ms-nada-kiswanson\" target=\"_blank\" rel=\"noreferrer noopener\">a Palestinian human rights group<\/a> who was suffering \u201congoing, well-organised and serious attacks, including death threats, interference in communications, intimidation, harassment and defamation\u201d in The Hague. Civil society human rights groups play an important role in providing evidence to and <a href=\"https:\/\/www.justiceinfo.net\/en\/112176-lobbying-icc-ngos-influencing-prosecutor-1.html\">lobbying the ICC<\/a>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-israel-and-us-senators-target-the-icc\">Israel and US senators target the ICC<\/h2>\n\n\n\n<p>Palestine accepted the Court\u2019s jurisdiction and deposited its instrument of accession to the ICC Statute in January 2015.&nbsp;According to <a href=\"https:\/\/www.theguardian.com\/world\/article\/2024\/may\/28\/spying-hacking-intimidation-israel-war-icc-exposed\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">The Guardian\u2019s reporting<\/a>, Israel\u2019s external security service Shin Bet, army intelligence directorate Aman, and the cyber-intelligence division Unit 8200 were involved in operations targeting the ICC from that date.&nbsp;<\/p>\n\n\n\n<p>Pressure on the ICC has also come from Israel\u2019s main backer, the United States. \u201cThe 2020 US sanctions targeted senior ICC officials, including former prosecutor Bensouda, disrupting their access to global banking services, resulting in non-US banks refusing to provide services, loss of insurance coverage, and difficulties in contracting with numerous commercial providers,\u201d reminds Chaikel. The US Senate\u2019s <a href=\"https:\/\/www.congress.gov\/bill\/118th-congress\/senate-bill\/224#:~:text=This%20bill%20imposes%20sanctions%20against,pursues%20charges%20against%20certain%20individuals.\" target=\"_blank\" rel=\"noreferrer noopener\">Illegitimate Court Counteraction Act of 2023<\/a><strong> \u201c<\/strong>imposes sanctions against International Criminal Court (ICC) employees and associates if the ICC investigates or pursues charges against certain individuals,\u201d including \u201cmembers of the armed forces of U.S. allies or partners\u201d.<\/p>\n\n\n\n<p>12 republican US Senators threatened Khan with sanctions <a href=\"https:\/\/www.politico.com\/f\/?id=0000018f-4e0e-d759-a9ff-ff4ee9420000\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">by letter in April<\/a>, shortly before the ICC prosecutor made public arrest warrants against Israel\u2019s Prime Minister Benjamin Netanyahu and Minister of Defence Yoav Gallant. \u201cIf you issue a warrant for the arrest of the Israeli leadership, we will interpret this not only as a threat to Israel\u2019s sovereignty but to the sovereignty of the United States. Our country demonstrated in the American Service-Members' Protection Act the lengths to which we will go to protect that sovereignty,\u201d wrote the senators, including Mitch McConnell, the leader of the Republicans at the US Senate. \u201cTarget Israel and we will target you\u2026 You have been warned.\u201d<\/p>\n\n\n\n<p>\u201cRegardless of the outcome of the [US presidential] election [on 5 November], whoever is elected has a duty and an obligation to ensure that the rule of law remains robust in the United States\u201d says Carmen Cheung the executive director of Center for Justice and Accountability, \u201cand that we continue to play an important role on the international stage when it comes to international justice. And that means, first and foremost, that we do not continue to attack and demonise the International Criminal Court as we have been\u201d.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-a-critical-time-for-the-court\">A critical time for the court<\/h2>\n\n\n\n<p>In May 2024, the ICC Office of the Prosecutor warned anyone attempting to interfere with the court\u2019s processes that such actions could constitute offenses against the administration of justice under Article 70 of the Rome Statute, the ICC\u2019s founding treaty, and must cease immediately. The presidency of the court\u2019s Assembly of States Parties <a href=\"https:\/\/asp.icc-cpi.int\/press-releases\/PR-20240517\" target=\"_blank\" rel=\"noreferrer noopener\">expressed its \u201cconcern\u201d<\/a> that same month over the \u201crecent public statements\u201d related to the Palestine investigation. \u201cThe Presidency regrets any attempts to undermine the Court\u2019s independence, integrity and impartiality. Some statements may constitute threats of retaliation against the Court and its officials, in the event the Court exercises its judicial functions as mandated in the Rome Statute,\u201d it said in a press release.<\/p>\n\n\n\n<p>ICC member states have been following their own <a href=\"https:\/\/asp.icc-cpi.int\/sites\/asp\/files\/2022-12\/PASP-Request-R169-Good-Practices.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">\u2018how-to\u2019 guide<\/a> to dealing with attacks on their court. In June this year 93 States issued <a href=\"https:\/\/www.legal-tools.org\/doc\/whl4qe3g\/\" target=\"_blank\" rel=\"noreferrer noopener\">a joint statement<\/a> expressing their \u201cunwavering support for the Court as an independent and impartial judicial institution\u201d. Another bullet point suggestion was: \u201cUse social media posts from official government accounts to swiftly react to a threat or attack, even before issuing official statements\u201d.&nbsp; Chaikel says \u201cICC member states need to urgently and actively defend the Court\u2019s independence and very survival, as the ICC is not designed to withstand these threats and attacks alone\u201d.<\/p>\n\n\n\n<p>Virginie Amato of the Coalition for the ICC, an NGO, describes the current situation as a critical time for the court, because even though \u201call this has happened before\u201d the pressures have been \u201crenewed with greater risks this year\u201d. They are \u201call aimed at undermining independence and work of the court\u201d.<\/p>\n\n\n\n<p>The court in currently still suffering from \u201cdealing with the aftermath of a serious cyberattack, which has been followed by ongoing cyberthreats [sic] and further attempted attacks,\u201d <a href=\"https:\/\/asp.icc-cpi.int\/sites\/default\/files\/asp_docs\/ICC-ASP-23-10-ENG.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">as outlined in the budget submission<\/a> which asks for a 10% increase on last year, including over 4 million for cyber security.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-sexual-harassment-allegations-against-karim-khan\">Sexual harassment allegations against Karim Khan<\/h2>\n\n\n\n<p>Over the last week a new anonymous X handle has been tweeting details of an alleged complaint of sexual harassment against the ICC prosecutor. The allegations were reflected <a href=\"https:\/\/www.dailymail.co.uk\/news\/article-13979123\/British-lawyer-called-Netanyahu-arrested-war-crimes-denies-misconduct-following-harassment-claims.html\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">in a British newspaper article<\/a> in which Karim Khan is \"accused of misconduct amid harassment claims involving a female colleague\u201d. The alleged facts apparently surfaced two weeks before Khan announced the arrest warrants against Israeli and Palestinian leaders. The Independent Oversight Mechanism (IOM), which is responsible for investigating allegations of misconduct by the court\u2019s staff, wrote that \u201cthe alleged affected individual declined to pursue a formal complaint with the IOM\u201d and \u201cthe alleged affected individual refused to explicitly confirm or deny to the IOM the factual basis of what had been reported by the third party to the IOM\u201d. The Daily Mail reported\u00a0Khan\u2019s denial of any wrongdoing and wrote that he \u201csuggested a deliberate smear campaign, saying he and the court were being subjected 'to a wide range of attacks and threats'\u201d.<\/p>\n\n\n\n<p>\u201cWe don\u2019t have enough information to assess if it might be part of a broader strategy to undermine the Court,\u201d says Chaikel. \u201cIt's also essential that, generally speaking, all allegations are taken seriously, to uphold the integrity of the ICC and to ensure that any potential complainant is given the necessary support and opportunity to speak out safely,\u201c she continues. Privately, journalists covering the court discuss the risk of narratives being used to strategically undermine the Court\u2019s credibility and legitimacy. <\/p>\n\n\n\n<p>karim Khan\u2019s <a href=\"https:\/\/asp.icc-cpi.int\/sites\/asp\/files\/asp_docs\/ASP19\/ICC-ASP-19-INF2-Add3-ENG-CEP-additional-appraisals.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">initial assessment<\/a> by states before <a href=\"https:\/\/www.justiceinfo.net\/en\/73621-election-karim-khan-battles-await-third-prosecutor-international-criminal-court.html\">elected<\/a> stated that \u201che demonstrated a clear commitment to a harassment-free workplace, drawing on concrete experience.\u201d In his own application for the job, he emphasised that he expected to be judged on his work and his ability to get his office to function. \u201cHaving been involved and led various cases in the ICC and in other national and international courts, I have seen what constitutes a good prosecution, and I have seen how inadequate ones get as far as they do. I have directly interviewed numerous survivors of SGBV [sexual and gender-based violence] and realise how important it is to ensure specialised handling of these witnesses during both the investigative and trial stages.
