What were the consequences?<\/p>\n\n\n\n<!--more-->\n\n\n\n<p>In 2025, it was the first time that states were called to discuss non-cooperation with the <a href=\"https:\/\/www.justiceinfo.net\/tribunals\/icc\">International Criminal Court (ICC)<\/a>, at the <a href=\"https:\/\/www.justiceinfo.net\/en\/153443-after-the-icc-assembly-the-elephants-remain-in-the-room.html\">Assembly of States Parties<\/a> (ASP). Besides pointing to ICC member states\u2019 failure to arrest Russia\u2019s Vladimir Putin and Israel\u2019s Benjamin Netanyahu, both under arrest warrants, the <a href=\"https:\/\/www.youtube.com\/watch?v=eipGIpIEQtM\">plenary meeting <\/a>held on December 3 in The Hague heard a recurring country name coming up in the civil society speeches: Italy.<\/p>\n\n\n\n<p>\u201cIn a context in which the court, its officials and civil society working for international justice are increasingly under attack, including through <a href=\"https:\/\/www.justiceinfo.net\/en\/140459-can-the-icc-survive-the-u-s-sanctions-part-1.html\">US sanctions<\/a>, each instance of non-cooperation is a further blow to the Rome statute system, especially when it comes from state parties\u201d, Cristina Orsini, senior programmes advisor at Lawyers for Justice in Libya, told the audience of states delegates and Ngos.<\/p>\n\n\n\n<p>On January 21, 2025, two days after his arrest in a Turin hotel following a warrant from the ICC, <a href=\"https:\/\/www.justiceinfo.net\/en\/140923-rome-defies-icc.html\">Osama Almasri Najim<\/a>, a former head of the Libyan judicial police, was released by Rome and flown back to Tripoli in an Italian government plane. The 46-year-old Libyan national was reportedly in charge of the notorious Mitiga prison in Tripoli. He is suspected of crimes against humanity and war crimes, including murder, torture, enslavement and sexual violence. After <a href=\"https:\/\/www.justiceinfo.net\/en\/146538-icc-libya-quagmire.html\">months of procedural back and forth<\/a> between the Court and Italy, <a href=\"https:\/\/www.icc-cpi.int\/sites\/default\/files\/CourtRecords\/0902ebd180ccfde4.pdf\">on October 17<\/a>, the ICC found that Italy failed to comply with its international obligation. But it did not refer the country to the next level up yet.<\/p>\n\n\n\n<p>\u201cIt is not possible to engage in any discussion concerning alleged non-compliance by my country in the absence of a formal referral\u201d [for lack of cooperation, to the ASP or the United Nations Security Council], declared Augusto Massari, Italy ambassador to the Netherlands, during the ASP plenary debate. He said that on the contrary Italy had provided \u201ctimely, transparent, and comprehensive responses\u201d and \u201cwill continue to engage in good faith with the court\u201d.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">\u201cThe message sent is very problematic\u201d<\/h2>\n\n\n\n<p>Opening the panel, ASP president P\u00e4ivi Kaukoranta focused on the states\u2019 obligations \u201cto engage in timely consultation with the court\u201d in case of problems with arresting or transferring suspects.<\/p>\n\n\n\n<p>\u201cItaly cited domestic legal and procedural issues to justify its decision. On the contrary, it seems that the mix of political concerns and diplomatic pressures led to the subordination of international obligations and justice considerations to political expediency\u201d, added Orsini during the panel. Speaking to Justice Info later, she recalled that \u201cItaly is not only a state party but also one of the founding members of the Court, so the message being sent is very problematic\u201d.<\/p>\n\n\n\n<p>Taking the word on behalf of the European Center for Constitutional and Human Rights (ECCHR) was David Yambio, co-founder of the Italian NGO Refugees in Libya. He said he was speaking as a \u201cvictim of innumerable violence of Almasri in many torture camps across Libya\u201d. His host country\u2019s failure to send the suspect to the ICC, had led him to \u201cface many threats, and to this day our lives have never been the same\u201d. Yambio concluded that in their \u201ccarefully crafted speeches\u201d, the member states, including Italy, had spoken about accountability and the suffering of victims, \u201cbut what you have not acknowledged is that our lives depend on the decisions that you make\u201d.<\/p>\n\n\n\t<div class=\"ArticleNewsletterCTA\">\r\n\t\t<div class=\"ArticleNewsletterCTATitle\">FIND THIS ARTICLE INTERESTING?<\/div>\r\n\t\t<div class=\"ArticleNewsletterCTAText\">\r\n\t\t\t<a href=\"\/en\/newsletter\">Sign up now for our (free) newsletter<\/a> to make sure you don't miss out on other publications of this type. \t\t<\/div>\r\n\t<\/div>\r\n\t\n\n\n<h2 class=\"wp-block-heading\">The ICC\u2019s timid reaction<\/h2>\n\n\n\n<p>In its October <a href=\"https:\/\/www.icc-cpi.int\/sites\/default\/files\/CourtRecords\/0902ebd180ccfde4.pdf\">decision<\/a>, the ICC found that \u201cItaly failed to comply with its international obligations under the Statute preventing the Court from exercising its functions and powers\u201d. Over the months, Italy brought forward reasons for sending Najim back to Libya instead of the Hague, including the formulation of the ICC warrant and another competing warrant previously sent by the Libyan authorities. However, the Court found that this do not \u201cexplain its failure to communicate and cooperate\u201d to resolve the alleged problems and do not provide \u201cany valid legal reason or reasonable justification for having immediately transferred Mr Najim back to Libya, instead of first consulting with the Court\u201d.<\/p>\n\n\n\n<p>Regarding the alleged extradition request by Libya, the judges said that \u201cMr Najim was not handed over to the Libyan authorities but returned as a free man\u201d. According to additional <a href=\"https:\/\/www.icc-cpi.int\/sites\/default\/files\/RelatedRecords\/0902ebd180d01df8.pdf\">evidence<\/a> filed by the prosecution on November 11, the Libyan request was notified to the Italian Ministry of Justice on January 22, 2025, after Najim was flown back to Tripoli in the evening of January 21. It was done \u201cwithout measures and documents, without any indication of the enforceable procedural title and\/or the arrest warrant\u201d, it reads.<\/p>\n\n\n\n<p>However, the ICC judges decided to wait before referring the country to the Assembly of States Parties or to the United Nations Security Council, whose 2011 referral of the Libyan situation sparked the Court\u2019s <a href=\"https:\/\/www.hrw.org\/news\/2022\/12\/04\/libya-icc-reignites-hope-long-delayed-justice#:~:text=Human%20Rights%20Watch%2C%20in%20March,unlawful%20executions%20in%20the%20prisons\">investigation<\/a>.<\/p>\n\n\n\n<p>Allison West, senior legal advisor at ECCHR, told Justice Info that Italy should be referred to the ASP or to the UNSC \u201cas a matter of principle\u201d. \u201cThese are procedures that have little concrete consequences beyond naming and shaming\u201d, Orsini told Justice Info. However, she thinks it would be important to bring the matter to a higher level.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Rome prosecutor\u2019s silenced reaction<\/h2>\n\n\n\n<p>The Rome chief prosecutor had placed Alfredo Mantovano, Undersecretary of State to the Presidency of the Council of ministers, as well as the Justice and Interior ministers Carlo Nordio and Matteo Piantedosi, under investigation \u2013 for failure to fulfil their official duties, aiding and abetting and embezzlement. In a vote on October 9, the Chamber of Deputies denied a request for authorisation to proceed against the three government officials. Twenty days later, the Ministers\u2019 Court shelved the investigation.&nbsp;<\/p>\n\n\n\n<p>Nevertheless, in Italy\u2019s <a href=\"https:\/\/www.icc-cpi.int\/sites\/default\/files\/RelatedRecords\/0902ebd180cec323.pdf\">response<\/a> to the ICC requests for more information on domestic proceedings, the country\u2019s ambassador to the Netherlands said that \u201cagainst Parliament\u2019s decision, the Judiciary has the power to raise the issue of a conflict of State powers attribution before the Constitutional Court.\u201d Massari added that the fact that the developments in the Najim case were \u201cwidely reported and disseminated to the public by the media, have at all levels clearly raised awareness of how significant, rich in implications and therefore complex the cooperation with this Court is\u201d. This can only have a \u201cpositive impact\u201d on the \u201cfuture requests for cooperation\u201d, he concluded.<\/p>\n\n\n\n<p>On <a href=\"https:\/\/www.dirittogiustiziaecostituzione.it\/ordinanza-della-corte-di-appello-di-roma-del-30-ottobre-2025-il-caso-almasri-alla-corte-costituzionale-di-david-mancini\/\">October 30<\/a>, the Appeal Court of Rome raised a question on the constitutional legitimacy of the laws on cooperation with the Hague Court. It asked the Constitutional Court to review the matter. Besides, the <a href=\"https:\/\/www.ecchr.eu\/pressemitteilung\/italy-to-answer-to-european-court-of-human-rights-after-failure-to-surrender-suspected-libyan-torturer-to-the-icc\/\">ECCHR<\/a> decided to support a case before the European Court of Human Rights brought by a torture survivor, who said he was unlawfully detained by Najim, against Italy for its failure to cooperate with the ICC. \u201cThis will be the first time that the Strasbourg Court actually examines a case of non-surrender to the ICC\u201d, West said.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Najim arrested in Libya?<\/h2>\n\n\n\n<p>In the late morning of November 5, Libyan and international media announced that <a href=\"https:\/\/www.theguardian.com\/world\/2025\/nov\/05\/libyan-general-accused-of-crimes-against-humanity-arrested-in-tripoli\">Najim had been arrested<\/a>. And a month later, Tripoli attorney general, Al-Siddiq Ahmed Al-Sour, confirmed in a special statement to <a href=\"https:\/\/akhbarlibya24.net\/2025\/12\/06\/%d8%a7%d9%84%d9%86%d8%a7%d8%a6%d8%a8-%d8%a7%d9%84%d8%b9%d8%a7%d9%85-%d8%a8%d8%b7%d8%b1%d8%a7%d8%a8%d9%84%d8%b3-%d8%a7%d9%84%d8%b5%d8%af%d9%8a%d9%82-%d8%a7%d9%84%d8%b5%d9%88%d8%b1-%d8%a3\">Libya News 24<\/a> that he remains in prison.<\/p>\n\n\n\n<p>However, \u201cdespite all of the public claims, we don\u2019t actually have any credible evidence yet that Najim has been arrested. According to the Libyan civil society groups we\u2019re in touch with, he remains at liberty\u201d, said West. According to her, this can be seen as an effort by the attorney general to signal that Libya is serious about cooperating with the ICC, while making it clear that they would like to prosecute crimes domestically. Besides, West explains that the Libyan judicial system remains too fragmented and under pressure from the different political and militia forces to ensure fair trials. \u201cOne of the fundamental issues at stake is that the charges that are proposed by the attorney general are for regular crimes under the Libyan Criminal Code, not international crimes\u201d, she added. To her, \u201cthe widespread and systematic attack on both Libyans and migrants and refugees that takes place across Libya really consolidates in the detention industry. It\u2019s incredibly important that it\u2019s placed in the broader context of crimes against humanity\u201d.<\/p>\n\n\n\n<p>On May 15, the ICC made public a <a href=\"https:\/\/www.icc-cpi.int\/news\/libya-accepts-icc-jurisdiction-over-alleged-crimes-2011-end-2027\">declaration<\/a> sent by the Libyan government to accept the Court jurisdiction from 2011 to 2027. In its half-yearly <a href=\"https:\/\/www.icc-cpi.int\/news\/statement-deputy-prosecutor-nazhat-shameem-khan-united-nations-security-council-situation-0\">statement<\/a> to the UN Security Council on November 26, Deputy Prosecutor Nazhat Shameem Khan said that her office remains \u201cfocused on securing the arrest and transfer of Mr. Osama Almasri Najim for trial at the ICC\u201d, and \u201cwould like to welcome the attorney-general of Libya to deepen his engagement in this common cause\u201d.<\/p>\n\n\n\n<p>The country arrested ICC suspects in the past, such as <a href=\"https:\/\/www.bbc.com\/news\/world-africa-40236808\">Saif al-Islam Gaddafi<\/a> in 2011, who was later freed, and more recently <a href=\"https:\/\/libyaobserver.ly\/news\/icc-wanted-criminal-tarhouna-mass-graves-arrested-libya\">Mohamed Al-Saleheen<\/a>, wanted in the context of the investigation into the Tarhuna mass graves. They were never surrendered to the ICC.<\/p>\n\n\n<div class=\"content-encadre\">\r\n\t<p><strong>A LIBYAN BEFORE THE ICC <\/strong><\/p>\n<p>Just before the States parties to the International Criminal Court (ICC) gathered to discuss non-cooperation, <a href=\"https:\/\/www.justiceinfo.net\/en\/153046-a-libyan-at-the-icc.html\">on December 1, 2025<\/a>, a Libyan has been brought before the Court to stand trial.\u00a0Khaled Mohamed Ali El-Hishri was a senior official of a militia known as RADA and is suspected of committing or overseeing crimes against humanity and war crimes in the Mitiga prison between 2015 and early 2020. He was arrested <a href=\"https:\/\/www.justiceinfo.net\/en\/147989-icc-new-chance-libyan-case.html\">on 16 July 2025<\/a> in Germany.<\/p>\n<p>\u201cThis is the very first case in the 15 years of the Libyan situation that\u2019s actually going to proceed to trial\u201d, underlined Allison West, senior legal advisor at the European Center for Constitutional and Human Rights.
