In August 2026, almost fifty years since the original inquest found no one to blame for his death, an inquest into the murder of anti-apartheid activist Stephen Bantu Biko re-opened at the High Court in Gqeberha, South Africa.<\/p>\n\n\n\n\n\n\n\n

On the 12th<\/sup> of September 1977, Stephen Bantu Biko was killed in detention by the South African Security Police. At the time of his murder, Biko was internationally recognised as the most brilliant and outspoken critic of the apartheid regime.<\/p>\n\n\n\n

Biko enrolled as a medical student at the University of Natal in 1966 and was the founder and first President of the South African Students Organisation. He was the intellectual leader of the Black Consciousness movement, and from 1977, he served as honorary president of the Black People\u2019s Convention (BPC), an organisation formed in protest against apartheid in 1972. After he was killed, Biko was immortalised through the work of artists, writers, and musicians<\/a>, and he became an iconic figure in the struggle for racial justice.<\/p>\n\n\n\n

Biko was arrested along with his comrade, Peter Jones, on the 18 August 1977, and taken to the Walmer Police Station and then to the notorious Sanlam Building, the headquarters of the Security Police in Port Elizabeth, Eastern Cape Province, now Gqeberha, Eastern Cape. On the 6th<\/sup> of September 1977, Biko was interrogated<\/a> and tortured<\/a> by Jacobus Beneke, Rubin Marx, Gideon Nieuwoudt, Daniel Siebert, and Harold Snyman. By the 11th<\/sup> of September, Biko was so severely wounded that he could not speak \u2013 he had suffered brain damage as a result of the assaults delivered by the Security Police. He was taken to Pretoria, naked and chained in the back of a land-rover, and the following day he was pronounced dead.<\/p>\n\n\n\n

The minister of Justice and Police, Jimmy Kruger, claimed Biko\u2019s death was the result of a hunger strike. The original inquest<\/a> found that \u201c[t]he cause or likely cause of Mr. Biko\u2019s death was a head injury, followed by extensive brain injury and other complications including renal failure. The head injury was probably sustained on the morning of 7 September during a scuffle with security police in Port Elizabeth. The available evidence does not prove that death was brought about by an act or omission involving an offence by any person\u201d.<\/p>\n\n\n\n

One of the 300 unresolved TRC cases<\/h2>\n\n\n\n

The Biko case is one of the more than 300 cases of gross violations of human rights committed during apartheid that remained unresolved at the end of the South African Truth and Reconciliation Commission. Although these cases were handed over to the National Prosecuting Authority, investigations were delayed and prosecutions obstructed for more than thirty years.<\/p>\n\n\n\n

It was only after decades of campaigning on the part of surviving family members, activists and lawyers working with the Foundation for Human Rights that the state was forced to re-open these unresolved matters in 2017. Progress has been excruciatingly slow, but the landmark verdict in the re-opened inquest into the death of anti-apartheid activist Ahmed Timol that determined that Timol was murdered<\/a> and that the surviving police officers implicated for his murder should be made to stand trial, has set a judicial precedent.<\/p>\n\n\n\n

The Biko family as well has consistently refused the historical amnesia of the post-apartheid state. In the 1990s, they applied to the Constitutional Court for the amnesty clause in the Truth and Reconciliation Commission to be declared unconstitutional. They went on to oppose the amnesty applications of Biko\u2019s killers, who continued to lie about their brutal deeds at the Commission\u2019s hearings.<\/p>\n\n\n\n

\u201cTo cure fifty years of pain and misery for our family\u201d<\/h2>\n\n\n\n

On the 12th<\/sup> of September 2025 the National Prosecuting Authority re-opened the inquest into the death of Steve Biko and proceedings began in August 2026. The lawyers representing the Biko family at the re-opened inquest requested additional time to prepare for the inquest, as delays caused by the uncertainty surrounding whether the legal costs<\/a> would be covered by the state meant that the legal team were only informed just before the start of proceedings that they were expected in court. On the 26 August 2026, Justice Isaac Madondo refused the request, arguing that as so much time had already been lost, it would be untoward to delay matters any further.<\/p>\n\n\n\n

For Nkosinathi Biko, Biko\u2019s eldest son and the spokesperson for the Biko family, after decades of waiting for justice, it is critical that the facts presented before the court are accurate and that the record is as complete as possible. In an interview<\/a> after the judges\u2019 decision, he stated: \u201cWe have asked the court to simply give this matter a little bit more time so that this matter is dealt with thoroughly. We have no other shot at this thing but this. And the task before this court is to cure fifty years of pain and misery for our family.\u201d The Biko family subsequently filed papers at the Eastern Cape High Court requesting an interim stay<\/a> in the inquest proceedings, and for the judge to be recused. The stay was granted on the 9th<\/sup> of September 2026, for an indefinite period.<\/p>\n\n\n\t

Unequivocal admissions of a former police chief<\/h2>\n\n\n\n

At the same time, the Khampepe Commission of Inquiry<\/a> into allegations about attempts to stop the investigations and prosecution of TRC cases is ongoing. Former National Commissioner of Police (2009-2011) and later minister of Police (2018-2024), Bheki Cele, testified<\/a> on 27 August before the Commission and accepted responsibility for the delays that occurred in prosecutions during the time he was in office. Cele conceded that his refusal to fund the legal costs of apartheid-era perpetrators impacted both the Nokuthula Simelane<\/a> and the COSAS 4<\/a> matters and delayed these cases by several years.<\/p>\n\n\n\n

Cele\u2019s admission and willingness to support the work of the ongoing Commission of Inquiry is in stark contrast to the position adopted by former presidents Thabo Mbeki and Jacob Zuma, who have been called to testify to account for the roles they are alleged to have played in making and upholding a secret agreement with apartheid-era generals to allow for back-door amnesties, and for obstructing investigations and prosecutions of the TRC cases. Their attempt, supported by President Cyril Ramaphosa, to have the chairperson of the Commission of Inquiry, former Justice Sisi Khampepe recused, was overturned by the Constitutional Court on the 31 August 2026<\/a>. However, the former presidents were granted leave to appeal, and the Jacob Zuma Foundation immediately announced that it intended to challenge the ruling and that it would open a criminal case<\/a> against Khampepe.<\/p>\n\n\n\n

The two surviving members of the Security Police team who assaulted Biko so severely that he was left comatose, were refused amnesty at the TRC, but have never been held to account for their crimes. Daniel Petrus Siebert and Jacobus Johannes Oosthuysen (Johan) Beneke have lived out their lives with impunity in the free South Africa that Biko gave his life to achieve. Siebert, who concluded his testimony at the inquest on 7th<\/sup> September 2026, denied<\/a> responsibility for Biko\u2019s murder. The callous disregard of state officials, past and present, toward the suffering of those who, like the Biko family, have spent decades without seeing justice done, ensures that the terrible harms perpetrated by the apartheid regime remain an open wound.<\/p>\n\n\n
