Venezuela obliged, Ecuador and Colombia are showing signs to please Washington, but Chile and Costa said no, and others keep silent.<\/p>\n\n\n\n<!--more-->\n\n\n\n<p class=\"wp-block-paragraph\">On 13 July, US Secretary of State Marco Rubio <a href=\"https:\/\/www.youtube.com\/watch?v=hgtCQOIV-Ys\">delivered a major policy speech<\/a> in which he vowed to dismantle the <a href=\"https:\/\/www.justiceinfo.net\/en\/tribunals\/icc\">International Criminal Court (ICC)<\/a>, one of the cornerstones of international justice, \u201cbrick by brick\u201d.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe US is launching <a href=\"https:\/\/www.justiceinfo.net\/en\/165858-the-us-campaign-against-the-icc-is-heating-up.html\">a diplomatic campaign<\/a> with a simple message \u2013 sovereign states over globalism. Those who benefit from American security must not stand idly by while those who provide that security are targeted,\u201d <a href=\"https:\/\/usunrome.usmission.gov\/why-were-dismantling-the-icc\/\">he wrote<\/a> the following day in an op-ed piece. The statement was directed, amongst others, at the Latin American governments that form part of his new geopolitical alliance, the Shield of the Americas, designed to tackle organised crime and dissuade countries from doing business with China.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In the two months since then, the diplomatic campaign announced by Rubio landed strongly in the region. Through a <a href=\"https:\/\/za.usembassy.gov\/state-department-launches-campaign-to-dismantle-international-criminal-courts-threat-to-american-sovereignty\/\">strategy<\/a> combining public appeals, high-level visits and diplomatic lobbying, Donald Trump\u2019s administration has been pressuring Latin American countries with right-wing governments to withdraw from the Court and the Rome Statute, which is its founding treaty.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">So far, the strategy has had mixed results. The sole country announcing its withdrawal was Venezuela, which has been the subject of an ongoing investigation by the ICC Prosecutor\u2019s Office into possible crimes against humanity since 2022, and the Trump administration has wielded enormous influence there since it ousted dictator Nicol\u00e1s Maduro. Chile and Costa Rica have publicly ruled out following suit, whilst other countries have subtly adopted Rubio\u2019s narrative or remained silent.<\/p>\n\n\n\n<h2 id=\"h-hegseth-steps-up-the-pressure\" class=\"wp-block-heading\">Hegseth steps up the pressure<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A month after Rubio\u2019s speech, US Secretary of War Pete Hegseth <a href=\"https:\/\/www.war.gov\/News\/Speeches\/Speech\/Article\/4572686\/secretary-of-war-pete-hegseth-delivers-remarks-at-the-americas-counter-cartel-c\/\">resumed the pressure<\/a> initiated by his cabinet colleague. During a forum on 12 August in Panama City organised by the Shield of the Americas, he \u201cstrongly encouraged\u201d the alliance\u2019s members to \u201cleave the ICC, and reject their attempts to rob your governments and your courts of your sovereignty\u201d. Hegseth\u2019s argument was that the Court could also investigate joint operations carried out by the United States with Latin American governments against organised crime, which he described as \u201c100 percent lawful under the laws of armed conflict\u201d.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Several operations led by US troops have already raised alarm bells. Air strikes in the Caribbean and the Pacific have left 234 people dead in extrajudicial killings in which, contrary to Hegseth\u2019s argument, the conditions for the existence of an armed conflict are not met. The United Nations High Commissioner for Human Rights, Volker T\u00fcrk, <a href=\"https:\/\/news.un.org\/es\/story\/2025\/10\/1540664\">characterised<\/a> them as such and pointed out that they violate international human rights law. An investigation led by the Latin American Centre for Investigative Journalism (CLIP) <a href=\"https:\/\/www.elclip.org\/bombardeados-sin-derecho-defensa-comando-sur-victimas-caribe-pacifico\/\">revealed<\/a> that 19 of the victims were poor coastal dwellers who were struggling to support their families as best they could and who were denied the right to a defence.<\/p>\n\n\n\n<h2 id=\"h-the-curious-case-of-venezuela\" class=\"wp-block-heading\">The curious case of Venezuela<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/www.justiceinfo.net\/en\/regions\/venezuela\">Venezuela<\/a>, the only country so far to have satisfied the Trump government\u2019s expectations and announced its withdrawal from the ICC or from the Rome Statute on which it is based, is a special case: it has been governed for almost three decades by the same political party, and its government <a href=\"https:\/\/www.icc-cpi.int\/venezuela-i\">has been under investigation<\/a> by the ICC Prosecutor\u2019s Office since 2021 for possible crimes against humanity, including arbitrary detentions, torture and other widespread abuses that occurred during the state repression in 2014 and 2017. After eight years of preliminary examination and five years of investigation, the case has not resulted in any charges and was affected by former Prosecutor Karim Khan\u2019s decision to trust the Chavista regime to investigate and punish those crimes (in accordance with the principle of complementarity) \u2013 something it failed to do \u2013 as well as by the sexual harassment affair that eventually cost Khan his job last July.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ultimately, <a href=\"https:\/\/www.justiceinfo.net\/en\/154205-trump-on-venezuela-the-rule-of-law-is-naked-lets-not-talk-about-it.html\">President Maduro was arrested by US forces<\/a> on 3 January, after which his then-deputy, Delcy Rodr\u00edguez, assumed power. Under the new interim government, changes have taken place, such as the release of more than 900 political prisoners and the lifting of censorship on independent media, although many reforms necessary for a transition to democracy remain pending.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On 24 July, Foreign Minister F\u00e9lix Plasencia <a href=\"https:\/\/www.dw.com\/es\/venezuela-inicia-retiro-definitivo-de-la-corte-penal-internacional\/a-78107081\">announced<\/a> the country\u2019s withdrawal from the ICC, attributing it to an order from Rodr\u00edguez and citing a \u201cdemonstrated geographical bias\u201d that is \u201cdetrimental to the Global South\u201d. That decision, which will take effect in a year\u2019s time, did, however, have a precedent from the Maduro era: in December 2025, the pro-government National Assembly had <a href=\"https:\/\/apnews.com\/article\/venezuela-estatuto-roma-corte-penal-internacional-ley-cpi-ce2de4668e0e1cade8e1214943dde15a\">passed a law<\/a> endorsing a withdrawal from the ICC. Maduro was arrested just three weeks later.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Curiously, the US State Department <a href=\"https:\/\/www.state.gov\/releases\/office-of-the-spokesperson\/2026\/07\/venezuela-withdraws-from-the-icc\/\">publicly welcomed Rodriguez\u2019s decision<\/a>, highlighting \u201cthe new Venezuelan government\u2019s partnership on American-led efforts to dismantle the corrupt and worthless ICC\u201d. It accused the international court of investigating Maduro \u201csince 2018 with no result\u201d, whilst the Trump administration was already bringing him to justice. It made no mention of the fact that the charges brought against him by the US Attorney\u2019s Office for the Southern District of New York include narco-terrorism, drug trafficking and the use of weapons, but none relating to the serious human rights violations in the country.<\/p>\n\n\n\n\n\n<h2 id=\"h-from-showing-muscles-to-making-political-calculations\" class=\"wp-block-heading\">From showing muscles to making political calculations<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The first Latin American official to publicly rule out the option of withdrawing from the Court was the Chilean Foreign Minister, Francisco P\u00e9rez Mackenna, at a press conference on 14 August. \u201cWe are members of the International Criminal Court and, whilst all organisations have room for improvement, we remain members of the ICC,\u201d <a href=\"https:\/\/www.latercera.com\/politica\/noticia\/canciller-descarta-abandonar-la-corte-penal-internacional-tras-fuerte-llamado-del-jefe-del-pentagono-a-aliados-latinoamericanos\/\">he said<\/a>, without giving further details but amidst a <a href=\"https:\/\/www.latercera.com\/cartas-al-director\/noticia\/preguntas-de-matamala\/\">major national public debate<\/a> on the pros and cons of joining Washington\u2019s initiative.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">His Costa Rican counterpart followed suit a week later. \u201cCosta Rica reaffirms its support for the International Criminal Court,\u201d <a href=\"https:\/\/www.nacion.com\/politica\/canciller-manuel-tovar-costa-rica-reafirma-su\/YO2TBPT7SBBQLK5AUSUR4AIWTE\/story\/\">said<\/a> Manuel Tovar. He, too, gave no details, although he was <a href=\"https:\/\/cnnespanol.cnn.com\/2026\/09\/25\/latinoamerica\/costa-rica-presidenta-destituye-canciller-reunion-escudo-americas-trump-orix\">dismissed<\/a> a few days ago by President Laura Fern\u00e1ndez for failing to notify her of a meeting with the US government.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ecuador has made no announcement, but eight days after <a href=\"https:\/\/ec.usembassy.gov\/es\/declaraciones-del-secretario-de-estado-marco-rubio-a-la-prensa\/\">Rubio\u2019s visit<\/a> to Quito to consolidate a <a href=\"https:\/\/www.state.gov\/translations\/spanish\/un-hemisferio-que-cumple\">regional security agenda<\/a>, President Daniel Noboa lambasted the international court in a <a href=\"https:\/\/www.youtube.com\/watch?v=XKSzACszGLk\">radio interview<\/a>. \u201cCertain global institutions are becoming ideologised and no longer deal with issues objectively. For example, the International Criminal Court has already become far too ideologically driven. Rather than being impartial institutions, they are becoming tools for certain factions to launch attacks,\u201d he said, echoing the Trump administration\u2019s stance but without elaborating further.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Current diplomatic priorities may have played a part in the calculations of two of these countries. Costa Rica <a href=\"https:\/\/www.rree.go.cr\/?sec=servicios&amp;cat=prensa&amp;cont=593&amp;id=8636\">is leading the bid<\/a> for its former vice-president and former minister, Rebeca Grynspan, to succeed Ant\u00f3nio Guterres as Secretary-General of the United Nations. In that election, she has already topped one of the <a href=\"https:\/\/www.securitycouncilreport.org\/whatsinblue\/2026\/09\/third-security-council-straw-poll-on-un-secretary-general-candidates.php\">straw polls<\/a> in the Security Council, with her closest rival being the former Guyanese minister Carolyn Rodrigues-Birkett.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ecuador is backing its ambassador, Marcelo V\u00e1zquez-Berm\u00fadez, to <a href=\"https:\/\/www.mvazquezbermudez.com\/statements#mvb\">win a seat as a judge<\/a> at the International Court of Justice, based like the ICC in The Hague. In addition, Ecuadorian jurist Osvaldo Zavala, currently the <a href=\"https:\/\/www.icc-cpi.int\/about\/registry\/who-s-who\/osvaldo-zavala-giler\">ICC's registrar<\/a>, <a href=\"https:\/\/www.expreso.ec\/ecuador\/john-reimberg-recibio-secretario-corte-penal-internacional-encuentro-293530.html\">met last month<\/a> with Interior Minister John Reimberg. He also <a href=\"https:\/\/www.eluniverso.com\/opinion\/columnistas\/el-derecho-internacional-protege-nota\/\">wrote an op-ed column<\/a> defending the Rome Statute and warning that \u201ccertain states that are not parties to it are seeking to dismantle the system by redefining the jurisdiction of the International Criminal Court as a challenge to sovereignty.\u201d In reality, Zavala argued, \u201cthe stability of a state governed by the rule of law is measured by its ability to remain within the framework of international law.\u201d<\/p>\n\n\n\n<h2 id=\"h-colombia-withdraws-its-candidate-for-icc-judge\" class=\"wp-block-heading\">Colombia withdraws its candidate for ICC judge<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Apart from those three, there are around ten countries that currently have right-wing governments and are part of the Shield of the Americas (also known as the Anti-Cartel Coalition of the Americas or A3C).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In Colombia, Abelardo de la Espriella\u2019s new government has made no statement regarding the ICC, although a recent decision suggests that pressure from Washington may be working. A week after <a href=\"https:\/\/www.infobae.com\/colombia\/2026\/09\/08\/marco-rubio-se-reune-con-el-presidente-de-colombia-abelardo-de-la-espriella-en-vivo-los-detalles-del-encuentro-en-barranquilla\/\">Rubio\u2019s visit<\/a> to Barranquilla, in Northern Colombia, <a href=\"https:\/\/elpais.com\/america-colombia\/2026-09-21\/el-gobierno-retira-la-candidatura-de-carolina-olarte-bacares-a-la-corte-penal-internacional.html\">the government withdrew the candidacy<\/a> of the lawyer and former ambassador Carolina Olarte-B\u00e1cares for the position of judge at the ICC, despite her being the only nominee from Latin America and the Caribbean and having been <a href=\"https:\/\/asp.icc-cpi.int\/sites\/default\/files\/asp_docs\/Report%20ACN.05Aug26.1000.pdf\">assessed<\/a> as \u2018highly qualified\u2019 by the advisory committee. The decision also came as a surprise because senior officials of the incoming administration had assured her that they would support her nomination, although the government has <a href=\"https:\/\/www.elcolombiano.com\/colombia\/de-la-espriella-estos-son-los-funcionarios-que-renunciaron-por-su-pasado-en-gobierno-petro-ED40070136\">also withdrawn other nominations<\/a> of public officials who served in the governments of Juan Manuel Santos or Gustavo Petro (for whom Olarte-B\u00e1cares served as ambassador in The Hague).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The positions on the ICC held by members of the current government have varied. Whilst Foreign Secretary Omar Bula has for years insisted that the Court <a href=\"https:\/\/www.youtube.com\/watch?v=XjQGcShYwfo\">is allegedly under the influence<\/a> of US financier and philanthropist George Soros \u2013 a frequent target of conspiracy theories from the far right linked to Trump \u2013 Legal Secretary Andr\u00e9s Barreto stood <a href=\"https:\/\/www.justiceinfo.net\/en\/44887-how-covid-19-can-derail-reparations-in-colombia-amazon.html\">as a candidate for a seat on the ICC<\/a> in 2020, and De la Espriella himself cited the Rome Statute in the <a href=\"https:\/\/www.justiceinfo.net\/en\/162603-radical-shift-colombias-new-presidents-stance-transitional-justice.html\">book on transitional justice<\/a> that he self-published a decade ago.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Any decision by the Colombian government to withdraw from the international court could backfire. It could end up favouring the former leaders of the Revolutionary Armed Forces of Colombia (FARC), for whom the De la Espriella government <a href=\"https:\/\/www.justiceinfo.net\/en\/162603-radical-shift-colombias-new-presidents-stance-transitional-justice.html\">says it wants harsher sentences<\/a> than those they have received under transitional justice. In reality, the ICC is one of the main sources of pressure ensuring that the Special Jurisdiction for Peace (JEP) \u2013 the judicial arm of Colombia\u2019s transitional system \u2013 does indeed <a href=\"https:\/\/www.justiceinfo.net\/en\/165193-colombia-how-jep-appeal-judges-corrected-first-historical-ruling.html\">comply with the retributive component<\/a> of its sanctions, as stipulated in the 2016 peace agreement. This is because, when the Court <a href=\"https:\/\/www.justiceinfo.net\/en\/84121-icc-backs-colombia-transitional-justice-model.html\">concluded its 17-year preliminary examination<\/a> of the country and endorsed its transitional model, it stated that it would continue to monitor compliance with the sanctions and could, in theory, reopen the investigation.<\/p>\n\n\n\n<h2 id=\"h-pressure-from-israel-silence-from-the-rest\" class=\"wp-block-heading\">Pressure from Israel, silence from the rest<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">In any case, pressure is also coming from other quarters. At a meeting last week in New York, Israeli Prime Minister Benjamin Netanyahu \u2013 who has <a href=\"https:\/\/www.justiceinfo.net\/en\/132173-behind-the-scenes-the-icc-prosecutor-coup-declat.html\">been charged<\/a> by the ICC Prosecutor\u2019s Office with allegedly committing war crimes and crimes against humanity in Gaza \u2013 <a href=\"https:\/\/www.abc.com.py\/politica\/2026\/09\/28\/israel-netanyahu-invito-a-pena-abandonar-la-corte-penal-internacional\/\">urged the presidents<\/a> of Bolivia, Panama and Paraguay to withdraw from the court. Neither they nor their governments have publicly stated their position. Nor has Argentina, whose president, Javier Milei, <a href=\"https:\/\/www.infobae.com\/politica\/2025\/12\/01\/argentina-exigio-una-accion-inmediata-de-la-corte-penal-internacional-en-venezuela-y-pidio-el-arresto-de-nicolas-maduro-y-diosdado-cabello\/\">has been critical<\/a> of the ICC Prosecutor\u2019s Office\u2019s slowness in the Venezuela case.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Two persons who follow international justice consulted by Justice Info relayed information they received secondhand that the Trump administration was planning to organise an event on the sidelines of the UN General Assembly in New York to potentially announce the withdrawal of several countries from the ICC. The event ultimately did not take place. A diplomatic source told Justice Info that there had been expectations that in Trump's speech full sanctions would be declared on the court, accompanied with a number of countries making withdrawal declarations. But \u2013 potentially \u2013 with the latter not happening, the former didn\u2019t\u2019 either.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The coming weeks will reveal just how effective the pressure from Rubio, Hegseth and Washington is in Latin American capitals.
