ICTR\/NSHAMIHIGO - NSHAMIHIGO ACCUSES MOST PART OF PROSECUTION WITNESSES OF HAVING LIED"},"content":{"rendered":"<p>Arusha, April 22, 2007 (FH) \u2013 Simeon Nshamihigo, a former magistrate in Rwanda\u2019s southwest accused of genocide, started his defense Wednesday before the International Criminal Tribunal for Rwanda (ICTR), alleging that that more than half of prosecution witnesses have lied.<br \/>\n\u00a0<br \/>\nIn its preliminary brief, Nsamihigo\u2019s lawyer, Mr. Denis Turcotte (Canada), specifically accused fourteen out of twenty-four prosecution witnesses, stating that they \u201ceither lied or contradicted their testimony.\u201d \u00a0Mr. Turcottte accused these individuals detained in Rwanda for their participation in the genocide of Tutsis in 1994 of being \u201ccriminal witnesses.\u201d \u00a0According to him because of their position, their depositions pose a \u201cmoral dilemma.\u201d<br \/>\n\u00a0<br \/>\nAccording to Mr. Turcotte, \u201cthe prosecution is not the holder of truth. \u00a0The only truth that exists at this time is that Mr. Nshamihigo is innocent of all the crimes of which he is accused.\u201d<br \/>\n\u00a0<br \/>\nArrested on May 19, 2001 while working under a false name as an investigator for the ICTR defense, Nshamihigo is accused of massacres of Tutsis in several locations in Cyangugu including at least four churches. \u00a0His trial stared on September 25, 2006. \u00a0The defendant has pleaded not-guilty.<br \/>\n\u00a0<br \/>\nMr. Turcotte has alleged that prosecution witnesses \u201chave themselves said that they hoped to be favourably viewed by judicial authorities in Rwanda following their testimony.\u201d \u00a0According to him, he has promised to call \u201cdirect witnesses to the events. \u00a0They will say that Nshamihigo did not participate in the massacres.\u201d \u00a0Nshamihigo\u2019s defense hopes to prove that the defendant rather housed \u201cfamilies and Tutsi friends to protect them.\u201d<br \/>\n\u00a0<br \/>\nMr. Turcotte brought up the vulnerability of the accused in this \u201cgrave crisis situation which was dangerous and paralyzing.\u201d \u00a0His home had been attacked, he explained. \u00a0\u201cEven the senior trial attorney wasn\u2019t immune from danger in Cyangugu at this time,\u201d pleaded Mr. Denis Turcotte who hopes to call \u201caround fifty witnesses.\u201d<br \/>\n\u00a0<br \/>\nNshamihigo also denies having participated in criminal meetings or having been a leader of the Interahamwe, the youth movement affiliated with the former presidential party considered the spearhead of the genocide. \u00a0\u201cIt is easy to state that Mr. Nshamihigo is an Interahamwe leader. \u00a0It\u2019s another thing to prove it,\u201d Mr. Turcotte stated.<br \/>\n\u00a0<br \/>\nWith regard to criminal meetings, Nshamihigo\u2019s lawyer indicated that his alleged associates had been acquitted by Rwandan courts or by the ICTR for lack of evidence. \u00a0At the ICTR, Nshamihigo is accused of collaborating with the former prefect of Cyangugu, Emmanuel Bagambiki, already exonerated by the judges.<br \/>\n\u00a0<br \/>\n\u201cWhat is the significance of the declaration of Bagambiki\u2019s innocence?\u201d the lawyer wondered.<br \/>\n\u00a0<br \/>\nBorn in Gutare, Cyangugu, Nshamihigo, aged 46, was an inspector for the judicial police from 1979 until 1980, and was then a senior trial attorney in 1994. \u00a0He worked in Kigali, Kibuye (west), and Cyangugu. \u00a0The prosecutor alleges that he was recruited by presenting \u201cfake credentials.\u201d \u00a0Nshamihigo rejects these allegations.<br \/>\n\u00a0<br \/>\nThe first eighteen witnesses will be heard until May 4. \u00a0The following session, which will last four weeks at most, will start \u201cimmediately or shortly after the end of this (phase),\u201d the presiding judge, Denis Byron (Saint Kitts and Nevis) said during a status conference on Monday. \u00a0Judge Byron is being assisted by the Burkinabe Judge Gustave Kam and the Czech Judge Robert Fremr.<br \/>\n\u00a0<br \/>\nAT\/PB\/KD\u00a0\u00a0<br \/>\n\u00a9 Hirondelle News Agency<br \/>\n<!--more-->22.04.07 - La d\u00e9fense de Nshamihigo entend prouver que \u00a0l\u2019accus\u00e9 avait plut\u00f4t h\u00e9berg\u00e9, \u00ab des familles et amis tutsis afin de les prot\u00e9ger \u00bb.<br \/>\n\u00a0<br \/>\nMe Turcotte a relev\u00e9 la vuln\u00e9rabilit\u00e9 de l\u2019accus\u00e9 en cette \u00ab situation de crise grave, dangereuse et paralysante \u00bb. Son domicile a \u00e9t\u00e9 attaqu\u00e9, a-t-il expliqu\u00e9. \u00ab M\u00eame le substitut du \u00a0procureur n\u2019\u00e9tait pas \u00e0 l\u2019abri du danger \u00e0 Cyangugu \u00e0 cette \u00e9poque \u00bb, a plaid\u00e9 Me Denis Turcotte qui pr\u00e9voit \u00ab environ cinquante t\u00e9moins \u00bb.<br \/>\n\u00a0<br \/>\nNshamihigo nie par ailleurs avoir particip\u00e9 \u00e0 des r\u00e9unions criminelles ou avoir \u00e9t\u00e9 un leader des Interahamwe, la jeunesse affili\u00e9e \u00e0 l\u2019ex-parti pr\u00e9sidentiel consid\u00e9r\u00e9e comme le fer de lance du g\u00e9nocide. \u00ab Il est facile d\u2019affirmer que M. Nshamihigo est un leader des Interahamwe. C\u2019est une autre chose de le prouver \u00bb, a d\u00e9clar\u00e9 Me Turcotte.<br \/>\n\u00a0<br \/>\nS\u2019agissant de la participation \u00e0 des r\u00e9unions criminelles, l\u2019avocat de Nshamihigo a indiqu\u00e9 que ses associ\u00e9s pr\u00e9sum\u00e9s avaient \u00e9t\u00e9 acquitt\u00e9s par les tribunaux rwandais ou par le TPIR faute de preuves.
