\nArusha, June 28th, 2005 (FH) - The International Criminal Tribunal for Rwanda (ICTR), Tuesday reiterated that it does not have enough evidence to prosecute Callixte Mbarushimana, a Rwandan former UN employee who is accused of taking part in the 1994 genocide in Rwanda. He is currently living in exile in France.\n<\/p>\n
<\/p>\n
\nBut according to Alloys Mutabingwa, Rwanda\u2019s special representative to the ICTR, there is nothing his country would like better than to have Mbarushimana extradited to Kigali.\n<\/p>\n
\n\u201cWhen the tribunal\u2019s Prosecutor (Hassan Bubacar Jallow) saw the file, he found that there was no new evidence to overturn his predecessor\u2019s conclusion that there was no enough evidence\u201d, the spokesperson of the tribunal, Roland Amoussouga, told Hirondelle News Agency.\n<\/p>\n
\nHe however confirmed that, \u201cthe Prosecutor has received a request to reopen Mbarushimana\u2019s file\u201d.\n<\/p>\n
\nThe accused, a former employee of the UNDP in Kigali, was in 2003 granted refugee status in France.\n<\/p>\n
\nThe French government announced Tuesday that it would be transmitting Mbarushimana\u2019s dossier to the \u201ccompetent judicial authorities\u201d. He is accused of being implicated in the murder of 33 people during the genocide.\n<\/p>\n
\nAccording to the Associated Press, the UN has, for the past year, been discretely urging both Rwanda and the ICTR to push for Mbarushimana\u2019s extradition.\n<\/p>\n
\nRwanda\u2019s envoy to the ICTR revealed that the Prosecutor of the ICTR has already handed over Mbarushimana\u2019s case file to Rwandan authorities. Mutabingwa argues that if the suspect cannot be transferred to the ICTR, then he should be handed over to Rwanda.\n<\/p>\n
\n\u201cThe ICTR is the international competent judicial authority while Rwanda is the national one\u201d, explained Mutabingwa.\n<\/p>\n
\nHe continued that the Rwandan office of the prosecutor has its own file on Mbarushimana.\n<\/p>\n
\n\u201c(Former ICTR Prosecutor) Carla Del Ponte made a grave mistake in dropping Mbarushimana\u2019s case\u201d, alleges Mutabingwa.\n<\/p>\n
\n\u201cShe refused to prosecute him on the pretext that his responsibility did not compare to Bagosora\u2019s and not because there was lack of evidence\u201d, claimed the Rwandan diplomat.\n<\/p>\n
\nColonel Theoneste Bagosora was the directeur de cabinet in the Rwandan ministry of defence and is considered by the prosecutor as being the \u201cmastermind\u201d of the genocide.\n<\/p>\n
