{"id":24511,"date":"2012-07-11T17:48:10","date_gmt":"2012-07-11T15:48:10","guid":{"rendered":"https:\/\/www.justiceinfo.net\/24511-110712-rwandatransfers-judges-rejects-appeal-against-referral-of-ntaganzwa-case-to-rwanda.html"},"modified":"2012-07-11T17:48:10","modified_gmt":"2012-07-11T15:48:10","slug":"110712-rwandatransfers-judges-rejects-appeal-against-referral-of-ntaganzwa-case-to-rwanda","status":"publish","type":"post","link":"https:\/\/www.justiceinfo.net\/en\/24511-110712-rwandatransfers-judges-rejects-appeal-against-referral-of-ntaganzwa-case-to-rwanda.html","title":{"rendered":"11.07.12 - RWANDA\/TRANSFERS - JUDGES REJECT APPEAL AGAINST REFERRAL OF NTAGANZWA CASE TO RWANDA"},"content":{"rendered":"<p>Arusha, July 11, 2012 (FH) \u2013 The Appeals Chamber of the International Criminal Tribunal for Rwanda (ICTR) has rejected the appeal lodged by lawyer for fugitive Ladislas Ntaganzwa to challenge the referral decision for transfer of his client\u2019s case to Rwanda for trial.<\/p>\n<p><!--more--><\/p>\n<p>Judges granted the prosecution\u2019s motion for striking out the notice of appeal after noting that it was invalidly filed for being lodged untimely.<\/p>\n<p>They further noted that the time limit for the filing of a notice of appeal ran from May 8, 2012, when the referral decision was issued and expired on May 23, 2012. But Duty Counsel for ex-Rwandan mayor, Francis Stolla, lodged the notice in question on June 8, 2012.<\/p>\n<p>\u201cProcedural time-limits are to be respected. Violations of these time-limits, unaccompanied by any showing of good cause, will not be tolerated. The Appeals Chamber rejects the notice of appeal as inadmissible and declares the case closed,\u201d reads part of their decision dated July 5, 2012.<\/p>\n<p>The move to oppose the referral had come after ICTR Prosecutor, Hassan Bubacar Jallow, handed over the case file for the fugitive to Rwandan authorities.
