Extraordinary African Chambers (EAC) Prosecutor Mback\u00e9 Fall on Wednesday asked the court to sentence former Chadian president Hiss\u00e8ne Habr\u00e9 to life in jail and confiscate all his assets. Fall was speaking on the third day of closing arguments in the Dakar trial of Habr\u00e9 for war crimes, crimes against humanity and torture committed under his rule (1982-1990). The defence takes the stand on Thursday.\u00a0<\/em><\/p>\n

Prosecutor Fall recapped Habr\u00e9\u2019s rule at length, telling the court that his seizure of power in 1982 was accompanied by repression in the south of Chad.\u00a0\u00a0<\/p>\n

\u201cBy September 6, 1982, the Armed Forces of the North (FAN) had conquered the whole of the south and started committing the worst atrocities,\u201d he said. \u00a0<\/p>\n

He then spoke about the creation of the Directorate of Documentation and Security (DDS), Habr\u00e9\u2019s political police. \u201cIt was in the DDS\u2019s places of death that the most human rights abuses were perpetrated,\u201d Fall told the court. \u201cThey included torture, inhumane treatment, rape, summary executions, abducting and \u2018disappearing\u2019 people.\u201d The Prosecutor said these \u201cconcentration camps\u201d constituted the \u201cfirst criminal act of Habr\u00e9, who encouraged the various crimes of torture and other crimes against humanity\u201d. <\/p>\n

Habr\u00e9\u2019s defence team, which takes the stand on Thursday, said they were not surprised by Fall\u2019s arguments. Court-assigned lawyer Mounir Balal said the prosecution had not managed to prove the guilt of the former president.<\/p>\n

On February 4, Habr\u00e9\u2019s chosen defence team, who are boycotting the trial, said at a press conference that Prosecutor Fall was \u201cthe right-hand man\u201d of current Chadian President Idriss Deby and Senegalese Justice Minister Sidiki Kaba, bent on \u201celiminating Habr\u00e9 physically and politically\u201d. \u201cWe have been watching a shameful masquerade whose sole aim is to eliminate one man, to take away his freedom and his life,\u201d declared French lawyer Fran\u00e7ois Serres.\u00a0 The defence also denounces a procedure it says has excluded Idriss D\u00e9by from the beginning.<\/p>\n

The Prosecutor\u2019s closing arguments were preceded on Monday February 8 and Tuesday 9 by the arguments of lawyers for the civil parties. Their arguments all focussed on the individual criminal responsibility of the accused.\u00a0\u00a0<\/p>\n

\u201cThis is a historic and emotional moment,\u201d said Chadian lawyer Jacqueline Moudeina, \u201cbecause it is the end of a long process. Hiss\u00e8ne Habr\u00e9 had the power of life and death over his people for the eight years that he ruled Chad with an iron fist. The witnesses who have come to the stand are completely traumatized.\u201d<\/p>\n

Lawyer Yar\u00e9 Fall said Habr\u00e9\u2019s responsibility was not in question, since it was he that had the prisoners executed. \u201cAs the overall boss, he did absolutely nothing to stop the killing, so he must take responsibility,\u201d he said. The Senegalese lawyer also said Habr\u00e9 had \u201cno consideration for the institutions of Senegal, the country that has hosted him since 1990. \u201cWhen the judges enter everyone rises except him,\u201d complained Yar\u00e9 Fall.<\/p>\n

Habr\u00e9 walled in silence\u00a0<\/h3>\n

Chadian lawyer Lamina Djindammadji\u00a0accused Habr\u00e9, whom he compares to Hitler, of decimating the intellectuals of his country. \u201cUnder his rule, prisoners were piled into 12 square-metre cells,\u201d he told the court. \u201cNot only were they given bad food but they were denied access to health care and subjected to inhumane treatment.\u201d<\/p>\n

The former Chadian head of State remained walled in silence, surrounded by three guards.<\/p>\n

\u201cThe rate at which people were dying in Chadian prisons is significantly higher than the worst rates of prisoner deaths recorded in the 20th century,\u201d said Belgian lawyer Henry Beautier. He also quoted a survey saying that Habr\u00e9\u2019s victims over 90 months were equivalent to 300 people in 133 rooms, making a total of not less than 40,000 victims.<\/p>\n

Beautier said rape, sexual slavery and prostitution were the lot of women in the prisons. This concurs with the testimony of Khadija Hassan Zidan who claimed to have been raped by Hiss\u00e8ne Habr\u00e9 himself.\u00a0<\/p>\n

The victims of the Habr\u00e9 regime were not only Chadians, according to lawyer Assane Dioma Ndiaye. He evoked the case of Senegalese jeweller Demba Gaye who died in the prisons of N'Djamena. Ndiaye said there was evidence that the DDS answered directly to Habr\u00e9.<\/p>\n

French lawyer William Bourdon closed arguments for the civil parties, declaring that \u201cthe word dignity is not in the vocabulary of Hissene Habr\u00e9, who soiled the very ground of Chad. He is beyond the norm. \u00a0He is a criminal who outstrips them all, even Pinochet.\u201d \u201cThis trial will allow the victims to regain a bit of their lost dignity,\u201d Bourdon told the court. \u201cWe hope that your verdict will be the start of hope for humanity.\u201d<\/p>\n
