{"id":26505,"date":"2016-03-24T11:41:12","date_gmt":"2016-03-24T10:41:12","guid":{"rendered":"https:\/\/www.justiceinfo.net\/26505-chad-court-order-but-no-cash-for-ex-dictators-victims.html"},"modified":"2016-03-24T11:41:12","modified_gmt":"2016-03-24T10:41:12","slug":"chad-court-order-but-no-cash-for-ex-dictators-victims","status":"publish","type":"post","link":"https:\/\/www.justiceinfo.net\/en\/26505-chad-court-order-but-no-cash-for-ex-dictators-victims.html","title":{"rendered":"Chad: Court Order, But No Cash, for Ex-Dictator\u2019s Victims"},"content":{"rendered":"<p>The Chadian government has failed to provide court-ordered reparations to over 7,000 victims of grave crimes under the rule of former dictator Hiss\u00e8ne Habr\u00e9, three rights groups said today.<\/p>\n<p>On March 25, 2015, after a three-month trial, a Chadian criminal court\u00a0<a href=\"http:\/\/www.hrw.org\/news\/2015\/03\/25\/chad-habre-era-agents-convicted-torture\">convicted<\/a>\u00a0<a href=\"http:\/\/www.hrw.org\/news\/2014\/11\/10\/chad-alleged-habre-accomplices-stand-trial\">20 Habr\u00e9-era security agents<\/a>\u00a0on charges of murder, torture, kidnapping, and arbitrary detention. The court also ruled that 7000 victims should receive a total of 75 billion CFA francs in reparations (US$129 million), ordering the government pay half and the convicted agents the other half. \u201cIt has been one year, and the Chadian government hasn\u2019t deigned to execute the court\u2019s decision.\u201d said <a href=\"http:\/\/www.hrw.org\/news\/2013\/08\/28\/jacqueline-moudeina-chad\">Jacqueline Moudeina<\/a>, lead lawyer for the victims and president of the Chadian Association for the Promotion and Defense of Human Rights (ATPDH). \u201cThis is a slap in the face to the victims and an affront to the rule of law.\u201d<\/p>\n<p>Habr\u00e9 himself has been on trial on charges of crimes against humanity, war crimes and torture since July 2015 before a specially constituted chamber within the Senegalese court system in Dakar. A verdict is expected on May 30, 2016.<\/p>\n<p>The Chadian court had ordered the government to create a commission to oversee the payment of compensation. But the commission has not yet been created.<\/p>\n<p>\u00a0<\/p>\n<p>The court also ordered the government to erect a monument \u201cin not more than one year\u201d to those killed under Habr\u00e9 and to create a museum in the former \u00a0headquarters of the Directorate of Documentation and Security (DDS), Habr\u00e9\u2019s political police, where victims were \u00a0tortured. Neither of these projects has been started. Nor has the state prosecutor carried out his duties under the decision, particularly the identification and confiscation of the assets of the convicted persons.<\/p>\n<p>\u201cThe government needs to implement the court\u2019s decision so that the victims, at long last, can receive reparations for what they suffered and so that steps are taken to remember what happened to us,\u201d\u00a0said Cl\u00e9ment Abaifouta, president of the Association of Victims of the Crimes of Hiss\u00e8ne Habr\u00e9, who as a prisoner under Habr\u00e9 was forced to dig graves for many of his fellow inmates. \u201cWe fought for 25 years for that decision and now the government is making us fight again to get the decision enforced.\u201d<\/p>\n<p>Habre\u2019s one-party rule, from 1982-1990, was marked by widespread atrocities, including the targeting of certain ethnic groups. DDS files\u00a0<a href=\"http:\/\/www.hrw.org\/legacy\/justice\/habre\/habre-police.htm\">recovered\u00a0<\/a>by Human Rights Watch in 2001\u00a0<a href=\"https:\/\/www.hrdag.org\/content\/chad\/Violence-de-lEtat-Tchadien.pdf\">reveal<\/a>\u00a0the names of 1,208 people who were killed or died in detention, and 12,321 victims of human rights violations. Habr\u00e9 was deposed by the current president, Idriss D\u00e9by Itno and fled to Senegal. His victims fought for decades to bring him to trial. In 2013, Senegal agreed on a\u00a0<a href=\"http:\/\/www.hrw.org\/news\/2012\/07\/24\/senegal-agreement-habr-court\">plan<\/a>\u00a0to create\u00a0<a href=\"https:\/\/www.hrw.org\/news\/2013\/09\/02\/statute-extraordinary-african-chambers\">Extraordinary African Chambers\u00a0<\/a>to conduct the trial within the Senegalese judicial system.\u00a0 That trial began on July 20, 2015 and ended on February 11, 2016.accused held key positions in the Chadian administration until they were arrested in 2013 and 2014.<\/p>\n<p>During the landmark trial in Chad, about 50 victims\u00a0<a href=\"http:\/\/www.hrw.org\/news\/2015\/01\/16\/chad-torture-detailed-trial\">described their torture<\/a>\u00a0and mistreatment at the hands of DDS agents. Among those sentenced to life in prison in the 2015 case in Chad \u00a0were Saleh Younous, former head of the DDS,\u00a0 and\u00a0<a href=\"http:\/\/www.hrw.org\/news\/2005\/01\/20\/chadian-feared-torturer-removed-un-mission-c-te-d-ivoire\">Mahamat Djibrine<\/a>,\u00a0described as one of the \u201cmost feared torturers in Chad\u201d by a 1992 Chadian Truth Commission.<\/p>\n<p>\u201cThe trial and conviction of state officials for human rights crimes was a remarkable development in a country where impunity has been the norm,\u201d said\u00a0<a href=\"http:\/\/www.hrw.org\/bios\/reed-brody\">Reed Brody<\/a>, counsel for Human Rights Watch, who has worked with Habr\u00e9\u2019s victims since 1999. \u201cThe government\u2019s failure to follow through on its obligations to the victims is a deep disappointment.\u201d<\/p>\n<p>\u00a0<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Chadian government has failed to provide court-ordered reparations to over 7,000 victims of grave crimes under the rule of former dictator Hiss\u00e8ne Habr\u00e9, three rights groups said today.
