{"id":26907,"date":"2016-04-18T08:10:30","date_gmt":"2016-04-18T06:10:30","guid":{"rendered":"https:\/\/www.justiceinfo.net\/26907-the-week-in-review-rwanda-hate-speech-verdict-and-no-freedom-of-speech-in-burundi.html"},"modified":"2016-04-18T08:10:30","modified_gmt":"2016-04-18T06:10:30","slug":"the-week-in-review-rwanda-hate-speech-verdict-and-no-freedom-of-speech-in-burundi","status":"publish","type":"post","link":"https:\/\/www.justiceinfo.net\/en\/26907-the-week-in-review-rwanda-hate-speech-verdict-and-no-freedom-of-speech-in-burundi.html","title":{"rendered":"The Week in Review: Rwanda \u201cHate Speech\u201d Verdict and No Freedom of Speech in Burundi"},"content":{"rendered":"<p>After a cascade of decisions on <a href=\"en\/live-feed\/26454.html?Itemid=102\" rel=\"alternate\">Bemba<\/a>, <a href=\"en\/component\/k2\/26585-question-of-genocide-at-the-heart-of-karadzic-judgment.html?Itemid=102\" rel=\"alternate\">Karadzic<\/a>,\u00a0<a href=\"en\/component\/k2\/26728-icty-reflects-strengths-and-weaknesses-of-international-justice.html?Itemid=102\" rel=\"alternate\">Seselj<\/a> and\u00a0<a href=\"en\/component\/k2\/26737-a-defeat-for-the-international-criminal-court.html?Itemid=102\" rel=\"alternate\">Ruto<\/a> in early April, this week was calmer in terms of transitional justice.\u00a0<\/p>\n<p>Nevertheless, Rwanda rendered an important\u00a0<a href=\"en\/component\/k2\/26890-rwandan-\u201chate-speech\u201d-professor-to-hear-verdict-friday.html\" rel=\"alternate\">verdict<\/a> in the case of university professor L\u00e9on Mugesera, a former leader in the party of assassinated ex-president Juv\u00e9nal Habyarimana who was extradited from Canada in 2012. A court in Kigali sentenced Mugesera to life in jail for inciting the anti-Tutsi genocide in 1994. Mugesera, a linguist who denied all the charges against him and argued he was already in Canada when the genocide started, immediately appealed the verdict.\u00a0He was convicted for a 1992 speech at a party rally. The judges deemed that this speech was one of the things that provoked the genocide. In it, he called Tutsis \u201ccockroaches\u201d and encouraged Hutus to kill them.\u00a0<\/p>\n<p>In neighbouring Burundi an apparent \u201crestoration of order\u201d hides the reality, as Professor Andr\u00e9 Guichaoua explains in an\u00a0<a href=\"en\/component\/k2\/26839-realities-and-illusions-behind-burundi\u2019s-\u201creturn-to-order\u201d.html?Itemid=102\" rel=\"alternate\">article<\/a> co-published by The Conversation and JusticeInfo.net.\u00a0<\/p>\n<p>\u201cOrder has been restored for the most part in Bujumbura, and this achievement should not be under-estimated,\u201d admits Guichaoua. But, he says, \u201cthe population is in shock. After 30 years of military rule and 10 of civil war, they thought they had freed themselves from ethnic segregation and political privilege and believed they could finally enjoy lasting peace in a stable, democratic and pluralist environment. But it would be an insult to think the Burundian people would give up forever these advances paid for so dearly just because of a presidential team\u2019s desire to stay in power beyond term limits\u201d.\u00a0\u00a0<\/p>\n<p>In Burundi, reconciliation and transition processes are currently up against a brick wall, as described in an open letter (\u201cWhat is left of freedom to think in Burundi?\u201d) by academics and others working on the country. \u201cOur words are our main tool in our work,\u201d they write. \u201cThey may seem useless in a context where arms prevail, but solutions will come from words, not arms.\u201d\u00a0<\/p>\n<p>This sentiment is no doubt shared by our colleague\u00a0<a href=\"en\/component\/k2\/26896-radio-ndeke-luka-correspondent-attacked-by-rebels-in-the-central-african-republic.html?Itemid=102\" rel=\"alternate\">Jean-Pierre Ngarassouma<\/a> from\u00a0<a href=\"http:\/\/www.radiondekeluka.org\/\" rel=\"alternate\">Radio Ndeke Luka<\/a> who was attacked on Monday along with his family because of his reporting on abuses by militia who have not been disarmed despite many promises to do so.<\/p>\n<p>\u00a0<\/p>\n<p>\u00a0<\/p>\n<p>\u00a0<\/p>\n","protected":false},"excerpt":{"rendered":"<p>After a cascade of decisions on Bemba, Karadzic,\u00a0Seselj and\u00a0Ruto in early April, this week was calmer in terms of transitional justice.\u00a0 Nevertheless, Rwanda rendered an important\u00a0verdict in the case of university professor L\u00e9on Mugesera, a former leader in the party of assassinated ex-president Juv\u00e9nal Habyarimana who was extradited from Canada in 2012.
