{"id":27442,"date":"2016-05-23T07:16:08","date_gmt":"2016-05-23T05:16:08","guid":{"rendered":"https:\/\/www.justiceinfo.net\/27442-week-in-review-transitional-justice-debates-from-tunisia-to-rwanda.html"},"modified":"2016-05-23T07:16:08","modified_gmt":"2016-05-23T05:16:08","slug":"week-in-review-transitional-justice-debates-from-tunisia-to-rwanda","status":"publish","type":"post","link":"https:\/\/www.justiceinfo.net\/en\/27442-week-in-review-transitional-justice-debates-from-tunisia-to-rwanda.html","title":{"rendered":"Week in Review: Transitional Justice Debates from Tunisia to Rwanda"},"content":{"rendered":"<p>Several hot debates took place this week on transitional justice, a field that is naturally controversial because still developing and often faced with extreme situations in very different countries.\u00a0\u00a0<\/p>\n<p>In Tunisia, for example, an International Crisis Group <a href=\"http:\/\/www.crisisgroup.org\/en\/regions\/middle-east-north-africa\/north-africa\/tunisia\/168-tunisia-transitional-justice-and-the-fight-against-corruption.aspx\" rel=\"alternate\">report <\/a>added a critical voice of authority on the transition process. \u201cA transitional justice expert would tell you that what is happening in Tunisia today is ill-planned transitional justice or `revolutionary justice`,\u201d the report\u2019s author Micha\u00ebl Bechir Ayari explained in an interview with JusticeInfo. \u201cThere are various transitional mechanisms, based on deals, whereas according to international norms, what should have been done first was to have a clear vision of the number of victims, draw up an overview of the conflicts that occurred and report on the violations.\u201d<\/p>\n<p>According to this ICG analyst, Tunisia needs, in order to promote business and the economy, to \u201cfind a middle way that would help renew the trust of the political elite and the people\u201d, and its Truth and Dignity Commission should \u201cmix a little water with its wine\u201d.<\/p>\n<p>It remains to be seen, however, what would be the political price to pay for such compromises.<\/p>\n<p>Another recurring debate in transitional justice is who tries whom and where. This question is raised by the ongoing genocide trial in France of <a href=\"en\/component\/k2\/27439-french-trial-hears-about-investigating-genocide-in-rwanda.html\" rel=\"alternate\">two former Rwandan mayors<\/a>. The trial is taking place under the suspicious eye of the Rwandan government and victims\u2019 associations, owing to the ambiguous role of France, which remained allied to the end of the Rwandan genocide with the regime of President Juv\u00e9nal Habyarimana. The two mayors have tried to play down their role, but as JusticeInfo reported, they were both key figures in the Rwandan dictatorial regime.<\/p>\n<p>Another former Rwandan mayor, Ignace Bagilishema, came to testify, 15 years after he was acquitted by the UN\u2019s International Criminal Tribunal for Rwanda (ICTR). \u201cHis lawyer, Fran\u00e7ois Roux, successfully placed his bets at the time on gathering facts, and going to the field,\u201d explains Franck Petit, JusticeInfo\u2019s correspondent at the Paris trial. \u201cHe was the first ICTR lawyer who managed to go himself to Rwanda to gather evidence on the ground and, in another first, get the ICTR judges transported to the sites in question. That makes us think of lawyer Fran\u00e7oise Math\u00e9\u2019s request here on the first day of the Paris trial that the Defence be granted transport to Rwanda.\u201d<\/p>\n<p>Amnesty International, the European Centre for Constitutional and Human Rights (ECCHR), International Federation for Human Rights (FIDH), Human Rights Watch, REDRESS, and TRIAL issued a joint <a href=\"https:\/\/www.hrw.org\/news\/2016\/05\/19\/eu-use-national-courts-fight-impunity\" rel=\"alternate\">statement <\/a>on May 19\u00a0urging the European Union and its member states to \u201cuse national courts to fight impunity\u201d. \u201cWhile, in principle, it would be preferable for justice to be carried out in the countries where the crimes are committed, this is often not possible,\u201d says the statement. \u201cThe application of universal jurisdiction reduces the existence of `safe havens`, where perpetrators of crimes can enjoy impunity. It is a critically important avenue toward justice for victims who have nowhere else to turn and can help spur accountability in the countries where the crimes were committed.\u201d<\/p>\n<p>It is now up to the French judges to prove this. On the other hand, the dubious cancellation of international arrest warrants against suspected coup leaders in\u00a0 Burkina Faso, reported by JusticeInfo, casts doubt on the independence of the judicial system in that country. <br \/>\u00a0<br \/>Another debate is developed on the website <a href=\"http:\/\/www.Justiceinconflict.org\">www.Justiceinconflict.org<\/a>\u00a0which presents an<a href=\"https:\/\/justiceinconflict.org\/2016\/05\/18\/lets-ditch-war-crimes-lets-not-get-carried-away-with-justice-criticism-and-cynicism\/\" rel=\"alternate\"> intelligent argument <\/a>for transitional justice whilst recognizing at the same time its limits. The article argues for the idea of \u201cpositive complementarity\u201d between different jurisdictions.
