{"id":27788,"date":"2016-06-09T13:45:32","date_gmt":"2016-06-09T11:45:32","guid":{"rendered":"https:\/\/www.justiceinfo.net\/27788-exclusive-top-un-whistleblower-resigns-citing-impunity-and-lack-of-accountability.html"},"modified":"2016-06-09T13:45:32","modified_gmt":"2016-06-09T11:45:32","slug":"exclusive-top-un-whistleblower-resigns-citing-impunity-and-lack-of-accountability","status":"publish","type":"post","link":"https:\/\/www.justiceinfo.net\/en\/27788-exclusive-top-un-whistleblower-resigns-citing-impunity-and-lack-of-accountability.html","title":{"rendered":"Exclusive: Top UN whistleblower resigns, citing impunity and lack of accountability"},"content":{"rendered":"<p><em><strong>UN whistleblower Anders Kompass, who exposed the sexual abuse of children by French and African peacekeepers in Central African Republic, is to resign in protest over what he sees as the organisation\u2019s failure to hold its senior officials to account.<\/strong><\/em><\/p>\n<p>\u201cThe complete impunity for those who have been found to have, in various degrees, abused their authority, together with the unwillingness of the hierarchy to express any regrets for the way they acted towards me sadly confirms that lack of accountability is entrenched in the United Nations,\u201d Kompass told IRIN. \u201cThis makes it impossible for me to continue working there.\u201d<\/p>\n<p>Kompass, field operations director at the Office of the United Nations High Commissioner for Human Rights, passed a confidential internal report on the abuse of children by French troops in CAR to the French authorities in 2014 after the UN failed to raise the alarm and stop the exploitation. The alleged abuse involved hungry children \u2013 as young as eight \u2013 in the <a href=\"http:\/\/www.irinnews.org\/report\/100862\/tough-conditions-car-displaced-airport-camp\">M\u2019Poko<\/a> camp for displaced people, coerced into sex in return for food or a little money.<\/p>\n<p>Instead of investigating those allegedly responsible for what proved to be an even wider crime \u2013 including the involvement of its peacekeepers \u2013\u00a0the UN\u2019s Office for Internal Oversight Services launched an internal investigation into Kompass\u2019 conduct. Accusing the former Swedish diplomat of leaking, it condemned his \u201cmisconduct\u201d, suspended him from his job, humiliatingly <a href=\"http:\/\/foreignpolicy.com\/2015\/06\/22\/un-france-child-sex-abuse-central-african-republic-obama-whitehouse-ban\/\">marched him out of his office<\/a>, and demanded his resignation.<\/p>\n<p>An independent panel later found senior UN managers to have \u201cabused their authority\u201d in the handling of the scandal.<\/p>\n<p>Paula Donovan of <a href=\"http:\/\/www.codebluecampaign.com\/\">Code Blue<\/a>, a campaign to end sexual exploitation by UN peacekeepers, says the UN\u2019s attitude left Kompass no alternative but to quit.<\/p>\n<p>\u201cI\u2019m not sure how you can work with a system that\u2019s gone out of its way to prove it can defeat anyone who tries to expose it,\u201d she told IRIN. \u201cDespite the platitudes, the assertions of intolerance for wrongdoing, it\u2019s all just empty phrases.\u201d<\/p>\n<p><strong><span class=\"h5\">Exonerated<\/span><\/strong><\/p>\n<p>Under pressure from several governments, UN Secretary-General Ban Ki-moon eventually appointed a three-person independent panel to review the UN\u2019s response to the reports of child sex abuse and its treatment of Kompass.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" src=\"images\/BanguisMpoko.jpg\" alt=\"\" width=\"671\" height=\"447\" \/>\u00a0 \u00a0Bangui's M'Poko camp for the displaced \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 A.Greco\/UNHCR<\/p>\n<p>\u00a0Nine months later, both the internal investigation and the external panel had exonerated him. The <a href=\"http:\/\/www.un.org\/News\/dh\/infocus\/centafricrepub\/Independent-Review-Report.pdf\">panel<\/a> also excoriated the UN\u2019s \u201cgross institutional failure\u201d \u2013 which enabled the <a href=\"https:\/\/www.crin.org\/en\/library\/news-archive\/un-transparency-whole-story-behind-peacekeeper-sex-abuse-central-african\">documented<\/a> forced oral sex and rape of 13 boys by 16 peacekeepers.<\/p>\n<p>Buck-passing meant nobody took action for more than a year, the panel report said. When French investigators tried to delve, just <a href=\"https:\/\/www.whistleblower.org\/blog\/011019-anders-kompass-cleared-un-official-who-reported-child-sexual-abuse-peacekeepers-speaks\">days<\/a> after Kompass had passed on the evidence, their efforts were frustrated by UN officials.<\/p>\n<p>Staff in both the UN mission in CAR, known as MINUSCA, and UNICEF, whose initial joint investigation formed the basis of the internal UN report Kompass <a href=\"http:\/\/static1.squarespace.com\/static\/514a0127e4b04d7440e8045d\/t\/55660871e4b086598604d7f9\/1432750193924\/04-2+-+Statement+by+Anders+Kompass%2C+OHCHR+-+March+29%2C+2015.pdf\">shared<\/a> with the French, failed to ensure that the identified children received proper care, or took steps to protect other potential victims, the independent panel found.<\/p>\n<p><strong><span class=\"h5\">Zero tolerance<\/span><\/strong><\/p>\n<p>The UN has trumpeted a \u201czero tolerance\u201d policy towards sexual abuse by peacekeepers since 2005. Ban has now pushed tough new measures. These include the addition of response teams in peacekeeping missions to handle abuse allegations, and the recall of units if perpetrators are not held to account.<\/p>\n<p>But the reports keep coming. More than 100 <a href=\"http:\/\/www.un.org\/apps\/news\/story.asp?NewsID=53619#.V06Td5F97IU\">new cases<\/a> of sexual abuse by UN and non-UN peacekeepers were reported in CAR in March \u2013 most involving children. The alleged attacks occurred between 2013 and 2015.<\/p>\n<p>Currently, <a href=\"http:\/\/www.un.org\/en\/peacekeeping\/contributors\/2016\/apr16_1.pdf\">123<\/a> countries have troops or police units deployed in 16 missions around the world. According to the UN, of the 60 largest troop contributing countries, only 14 have not reported cases of sexual abuse committed by their forces in the past five years.<\/p>\n<p>The UN has historically argued that it has no jurisdiction over the troops provided by contributing countries for peacekeeping missions \u2013 they can only be prosecuted at home. The need for peacekeepers may have also acted as a disincentive to demand stricter standards. Some countries have <a href=\"http:\/\/www.un.org\/press\/en\/2016\/sc12277.doc.htm\">resisted<\/a> the new reforms. \u00a0<\/p>\n<p>Human Rights Watch <a href=\"https:\/\/www.hrw.org\/news\/2016\/06\/07\/central-african-republic-murder-peacekeepers\">reported<\/a> today that African Union peacekeepers from Congo-Brazzaville serving in CAR allegedly killed at least 18 people, including women and children, between December 2013 and June 2015 and dumped their bodies in a mass grave outside their base. The government has so far ignored UN requests for a judicial investigation, the rights group said.<\/p>\n<p>The UN is urging member states to work with it to prevent and react expeditiously to abuse. In February, the UN <a href=\"http:\/\/www.un.org\/apps\/news\/story.asp?NewsID=53185#.V06l8ZF97IU\">appointed<\/a> Jane Holl Lute, previously a senior official in UN peacekeeping, as special coordinator on \u201cimproving the UN\u2019s response to sexual exploitation and abuse\u201d.<\/p>\n<p>In a <a href=\"http:\/\/www.codebluecampaign.com\/latest-news\/2016\/5\/16\">briefing<\/a> to the UN General Assembly last month, Lute stressed that \u201cmuch has been done\u201d, and outlined a package of toolkits and guidelines that is in the works.<\/p>\n<p>But nearly two years after the CAR scandal broke, Donovan is scathing. \u201cAlthough he says he has zero tolerance, Ban Ki-moon has appointed someone to <em>coordinate<\/em> what has been identified as just a failed, broken system.<\/p>\n<p>\u00a0<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" src=\"images\/CatlanneTijerina.jpg\" alt=\"\" width=\"685\" height=\"456\" \/><\/p>\n<p>\u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0Un photo\/Catlanne Tijerina<\/p>\n<p>\u201cIf you set the bar so low \u2013 that you are going to coordinate these dysfunctional entities, and try and <em>improve<\/em> the response \u2013 that just says it all,\u201d she said.<\/p>\n<p>While the UN has focused on reforming the system at the ground level, critics point to the relative impunity enjoyed by those in the highest echelons of the UN civil service \u2013 an accountability vacuum they say the Kompass case has laid bare.<\/p>\n<p><span class=\"h5\"><strong>Abusing authority<\/strong><\/span><\/p>\n<p>The independent panel\u2019s report found that three officials had specifically \u201cabused their authority\u201d: Babacar Gaye, the special representative of the secretary-general for MINUSCA; Carman Lapointe, under-secretary-general for the Office of Internal Oversight Services (OIOS), and Renner Onana, the chief of the Human Rights and Justice Section in MINUSCA.<\/p>\n<p>Ban fired Gaye in August 2015 after UN peacekeepers were <a href=\"https:\/\/www.amnesty.org\/en\/latest\/news\/2015\/08\/car-un-troops-implicated-in-rape-of-girl-and-indiscriminate-killings-must-be-investigated\/\">accused<\/a> of raping a 12-year-old girl and killing a 16-year-old boy and his father. Lapointe, who initiated the internal investigation into Kompass, resigned in September 2015. But Onana remains a senior official in the UN mission in CAR.<\/p>\n<p>Susana Malcorra, Ban\u2019s chief of staff, came in for criticism by the independent report over a \u201cconflict of interest\u201d. She facilitated a meeting with OIOS and the UN Ethics Office \u2013 two bodies that should operate at arm\u2019s length from the UN system \u2013 to discuss what to do about Kompass. The report, however, absolved her of abusing her authority.<\/p>\n<p>She resigned in November 2015 to become Argentina\u2019s foreign minister. Her hat is in the ring as a <a href=\"http:\/\/www.nytimes.com\/2016\/05\/21\/world\/americas\/susana-malcorra-secretary-general.html\">candidate<\/a> to succeed Ban as secretary-general.<\/p>\n<p>The meeting to discuss the Kompass case was held at the urging of Zeid Ra\u2019ad Al Hussein, the UN High Commissioner for Human Rights and Kompass\u2019 boss. He had \u201ca single-minded determination to pursue an investigation\u201d into Kompass and \u201cundoubtedly\u201d risked compromising the independence of OIOS and the UN Ethics Office, the panel report found.<\/p>\n<p>Al Hussain\u00a0\u201cis still vocally, publicly refusing to acknowledge what Anders did was appropriate, and what he [Zeid] did was wrong and retaliatory,\u201d said Bea Edwards of the US-based Government Accountability Project, which tries to protect whistleblowers.<\/p>\n<p>Al Hussain\u00a0<a href=\"http:\/\/www.nytimes.com\/2015\/12\/23\/world\/un-wants-sexual-abuse-reported-immediately.html?_r=0\">told<\/a> the New York Times last year that he felt Kompass had done \u201cthe right thing wrongly\u201d. Al Hussain\u2019s office did not respond to IRIN\u2019s requests for comment. Neither did OIOS, the Ethics Office or UN spokesman St\u00e9phane Dujarric.<\/p>\n<p><span class=\"h5\"><strong>Hard decision<\/strong><\/span><\/p>\n<p>Kompass says he shared the internal report with the French authorities with the sole purpose of ending the abuse as quickly as possible. Doing so was not in and of itself wrong, according to UN procedures \u2013 in fact, sharing information with governments to advocate for changes in behaviour was part of Kompass\u2019 job description.<\/p>\n<p>But while the UN has suggested that Kompass did not follow normal procedures, the independent panel said it was \u201cdisingenuous\u201d for the UN to label his actions as \u201cmisconduct\u201d.<\/p>\n<p>Citing a separate case in which Kompass was accused of providing information to the Moroccan government about Western Sahara for \u201cpersonal gain\u201d, one past media report suggested that he was seen in the UN as \u201c<a href=\"http:\/\/foreignpolicy.com\/2015\/06\/22\/un-france-child-sex-abuse-central-african-republic-obama-whitehouse-ban\/\">an untrustworthy shill for a foreign government<\/a>\u201d. \u00a0<\/p>\n<p>Such rhetoric and Kompass\u2019 treatment may well give other potential whistleblowers pause.<\/p>\n<p>\u201cThe point of whistleblowing is that somebody will be held responsible for criminal misconduct,\u201d said Edwards. \u201cThose that have taken the risk to report should be protected, commended and rewarded.\u201d<\/p>\n<p>Kompass, 60, is to resign on 31 August, one year before the end of his current contract.\u00a0He has <a href=\"https:\/\/twitter.com\/martin_tunstrom\/status\/735909038786007041\" target=\"_blank\" rel=\"noopener\">reportedly<\/a>\u00a0accepted a job at the Swedish foreign ministry.<\/p>\n<p>\u201cIt was a very hard decision for me to take, after a total of 21 years of service with the United Nations,\u201d he told IRIN, \u201cbut one that I feel was unavoidable.\u201d<\/p>\n<p><em>Coming up:\u00a0In an exclusive commentary, Anders Kompass details the reasons for his resignation.<\/em><\/p>\n<p>The article is published by\u00a0<a href=\"http:\/\/www.irinnews.org\/news\/2016\/06\/07\/exclusive-top-un-whistleblower-resigns-citing-impunity-and-lack-accountability?utm_source=IRIN%20-%20the%20inside%20story%20on%20emergencies&amp;utm_campaign=31b707a9b3-RSS_EMAIL_ENGLISH_ALL&amp;utm_medium=email&amp;utm_term=0_d842d98289-31b707a9b3-15707729\">IRIN\u00a0<\/a><\/p>\n<p>\u00a0<\/p>\n","protected":false},"excerpt":{"rendered":"<p>UN whistleblower Anders Kompass, who exposed the sexual abuse of children by French and African peacekeepers in Central African Republic, is to resign in protest over what he sees as the organisation\u2019s failure to hold its senior officials to account. \u201cThe complete impunity for those who have been found to have, in various degrees, abused [&hellip;]<\/p>\n","protected":false},"author":64,"featured_media":67598,"comment_status":"open","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"_acf_changed":false,"footnotes":""},"categories":[567],"tags":[],"ji_location":[2165],"class_list":["post-27788","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-opinion","ji_location-central-african-republic"],"acf":[],"yoast_head":"<!-- This site is optimized with the Yoast SEO Premium plugin v25.3.1 (Yoast SEO v25.3.1) -
