Secret prisons in southern\u00a0<a class=\"bn-clickable\" href=\"http:\/\/www.aljazeera.com\/news\/2017\/06\/hrw-uae-backs-torture-disappearances-yemen-170622094158991.html\" target=\"_blank\" rel=\"nofollow noopener\" data-beacon=\"{&quot;p&quot;:{&quot;lnid&quot;:&quot;Yemen&quot;,&quot;mpid&quot;:5,&quot;plid&quot;:&quot;http:\/\/www.aljazeera.com\/news\/2017\/06\/hrw-uae-backs-torture-disappearances-yemen-170622094158991.html&quot;}}\" data-beacon-parsed=\"true\">Yemen<\/a>, where officials have forcibly disappeared people and ordered continued arbitrary detention, are called \u201cno-return prisons.\u201d And these are just a few of the many places where enforced disappearances are occurring with terrible human consequences.<\/p>\n<\/div>\n<div class=\"content-list-component bn-content-list-text text\" data-beacon=\"{&quot;p&quot;:{&quot;mnid&quot;:&quot;citation&quot;}}\" data-beacon-parsed=\"true\">\n<p>Enforced disappearance was a phenomenon many thought was a product of the brutal internal conflicts of the 1980s and early 1990s. Tremendous efforts were taken by countries and the international community to address the crime, on a number of fronts.<\/p>\n<\/div>\n<div class=\"content-list-component bn-content-list-text text\" data-beacon=\"{&quot;p&quot;:{&quot;mnid&quot;:&quot;citation&quot;}}\" data-beacon-parsed=\"true\">\n<p>In 1992, the Argentinian government created a\u00a0<a class=\"bn-clickable\" href=\"https:\/\/www.usip.org\/publications\/1983\/12\/truth-commission-argentina\" target=\"_blank\" rel=\"nofollow noopener\" data-beacon=\"{&quot;p&quot;:{&quot;lnid&quot;:&quot;National Commission on the Disappearance of Persons&quot;,&quot;mpid&quot;:6,&quot;plid&quot;:&quot;https:\/\/www.usip.org\/publications\/1983\/12\/truth-commission-argentina&quot;}}\" data-beacon-parsed=\"true\">National Commission on the Disappearance of Persons<\/a>, arguably the first truth commission, to identify and reveal the fates of the estimated 30,000 disappeared during the \u201cDirty War\u201d (1976-1983). Despite the commission\u2019s limitations \u2013 it did not name names and was only able to account for a small proportion of victims \u2014 its work opened the door to much more extensive prosecutions, reparations, and truth telling. It also set a powerful precedent for dealing with enforced disappearances and massive human rights violations, which has inspired similar commissions in dozens of countries.<\/p>\n<\/div>\n<div class=\"content-list-component bn-content-list-text text\" data-beacon=\"{&quot;p&quot;:{&quot;mnid&quot;:&quot;citation&quot;}}\" data-beacon-parsed=\"true\">\n<p>Following the genocide in Srebrenica in 1995 and crimes committed throughout the former Yugoslavia during the Yugoslav War, many enforced disappearances were documented and remains found by courageous local and national activists and organizations as well as international bodies such as the\u00a0<a class=\"bn-clickable\" href=\"https:\/\/www.icmp.int\/\" target=\"_blank\" rel=\"nofollow noopener\" data-beacon=\"{&quot;p&quot;:{&quot;lnid&quot;:&quot;International Commission on Missing Persons&quot;,&quot;mpid&quot;:7,&quot;plid&quot;:&quot;https:\/\/www.icmp.int\/&quot;}}\" data-beacon-parsed=\"true\">International Commission on Missing Persons<\/a>\u00a0and the\u00a0<a class=\"bn-clickable\" href=\"http:\/\/www.icty.org\/\" target=\"_blank\" rel=\"nofollow noopener\" data-beacon=\"{&quot;p&quot;:{&quot;lnid&quot;:&quot;International Criminal Tribunal for the former Yugoslavia&quot;,&quot;mpid&quot;:8,&quot;plid&quot;:&quot;http:\/\/www.icty.org\/&quot;}}\" data-beacon-parsed=\"true\">International Criminal Tribunal for the former Yugoslavia<\/a>. This led to criminal convictions at the Tribunal and in national courts. Chile is still using its national courts to\u00a0<a class=\"bn-clickable\" href=\"https:\/\/www.ictj.org\/news\/judgments-chile-progress-prosecuting-state-disappearances\" target=\"_blank\" rel=\"nofollow noopener\" data-beacon=\"{&quot;p&quot;:{&quot;lnid&quot;:&quot;try&quot;,&quot;mpid&quot;:9,&quot;plid&quot;:&quot;https:\/\/www.ictj.org\/news\/judgments-chile-progress-prosecuting-state-disappearances&quot;}}\" data-beacon-parsed=\"true\">try<\/a>\u00a0hundreds of people for their roles in some of the estimated 2,279 enforced disappearances committed during Augusto Pinochet\u2019s military dictatorship (1973-1990).<\/p>\n<div class=\"content-list-component bn-content-list-text text\" data-beacon=\"{&quot;p&quot;:{&quot;mnid&quot;:&quot;citation&quot;}}\" data-beacon-parsed=\"true\">\n<p>The\u00a0<a class=\"bn-clickable\" href=\"http:\/\/www.ohchr.org\/EN\/HRBodies\/CED\/Pages\/ConventionCED.aspx\" target=\"_blank\" rel=\"nofollow noopener\" data-beacon=\"{&quot;p&quot;:{&quot;lnid&quot;:&quot;International Convention for the Protection of All Persons from Enforced Disappearances&quot;,&quot;mpid&quot;:10,&quot;plid&quot;:&quot;http:\/\/www.ohchr.org\/EN\/HRBodies\/CED\/Pages\/ConventionCED.aspx&quot;}}\" data-beacon-parsed=\"true\">International Convention for the Protection of All Persons from Enforced Disappearances<\/a>, from 2007, establishes important legal obligations for its signatories. The only countries in the Middle East and Northern Africa to have joined are Iraq and Morocco. Iraq did so in 2010, after being repeatedly named as leading the world in enforced disappearances.<\/p>\n<\/div>\n<div class=\"content-list-component bn-content-list-text text\" data-beacon=\"{&quot;p&quot;:{&quot;mnid&quot;:&quot;citation&quot;}}\" data-beacon-parsed=\"true\">\n<p>Part of the disproportionate lack of attention to the disappeared in the region may arguably be due to the inordinate focus on countering terrorism, whether called \u201cviolent extremism\u201d or another moniker. Anti-terrorism has been the primary objective of Western foreign policy, and by extension, Western justice policy, since the tragic events of 9\/11 and the so-called \u201cGlobal War on Terrorism\u201d. This unfortunate, short-sighted focus takes us farther away from accountability and prevention.<\/p>\n<\/div>\n<div class=\"content-list-component bn-content-list-text text\" data-beacon=\"{&quot;p&quot;:{&quot;mnid&quot;:&quot;citation&quot;}}\" data-beacon-parsed=\"true\">\n<p>The situation in Kenya and Somalia are examples of this fallacy. A 2013\u00a0<a class=\"bn-clickable\" href=\"http:\/\/digitalcommons.law.seattleu.edu\/tjrc\/\" target=\"_blank\" rel=\"nofollow noopener\" data-beacon=\"{&quot;p&quot;:{&quot;lnid&quot;:&quot;report&quot;,&quot;mpid&quot;:11,&quot;plid&quot;:&quot;http:\/\/digitalcommons.law.seattleu.edu\/tjrc\/&quot;}}\" data-beacon-parsed=\"true\">report<\/a>\u00a0by Kenya\u2019s Truth, Justice and Reconciliation Commission identified enforced disappearances as violations that should not be repeated. Yet, in the name of fighting Al-Shabab in both\u00a0<a class=\"bn-clickable\" href=\"http:\/\/ohrh.law.ox.ac.uk\/lifting-the-veil-on-enforced-disappearances-and-extrajudicial-killings-in-kenya\/\" target=\"_blank\" rel=\"nofollow noopener\" data-beacon=\"{&quot;p&quot;:{&quot;lnid&quot;:&quot;Kenya&quot;,&quot;mpid&quot;:12,&quot;plid&quot;:&quot;http:\/\/ohrh.law.ox.ac.uk\/lifting-the-veil-on-enforced-disappearances-and-extrajudicial-killings-in-kenya\/&quot;}}\" data-beacon-parsed=\"true\">Kenya<\/a>\u00a0and Somalia, they have instead increased: human rights organizations have documented over 300 cases of individuals who have gone missing while in the custody of Kenyan security agencies since 2009. (To date, the police have not undertaken investigations into their whereabouts.)<\/p>\n<\/div>\n<div class=\"content-list-component bn-content-list-text text\" data-beacon=\"{&quot;p&quot;:{&quot;mnid&quot;:&quot;citation&quot;}}\" data-beacon-parsed=\"true\">\n<p>In order to effectively\u00a0<em>prevent<\/em>\u00a0enforced disappearances, whether in Syria or the myriad of other places where it is occurring today, the international community will need to rethink its priorities and approach. Today, more than ever, human rights advocates must continue to push for the implementation of the\u00a0<a class=\"bn-clickable\" href=\"http:\/\/www.ohchr.org\/EN\/HRBodies\/CED\/Pages\/ConventionCED.aspx\" target=\"_blank\" rel=\"nofollow noopener\" data-beacon=\"{&quot;p&quot;:{&quot;lnid&quot;:&quot;International Convention for the Protection of All Persons from Enforced Disappearances&quot;,&quot;mpid&quot;:13,&quot;plid&quot;:&quot;http:\/\/www.ohchr.org\/EN\/HRBodies\/CED\/Pages\/ConventionCED.aspx&quot;}}\" data-beacon-parsed=\"true\">International Convention for the Protection of All Persons from Enforced Disappearances<\/a>. We must also look to the international community to lead the way in unequivocally censoring governments that use enforced disappearance as a political tactic \u2014 and ensuring there can be no impunity for this crime.<\/p>\n<\/div>\n<div class=\"content-list-component bn-content-list-text text\" data-beacon=\"{&quot;p&quot;:{&quot;mnid&quot;:&quot;citation&quot;}}\" data-beacon-parsed=\"true\">\n<p>In a country such as Syria, where the state and rebel groups have had virtual carte blanche to commit atrocities for seven long years, the war will likely need to end in order to stop the abuses. Nonetheless, to address the horrors of enforced disappearances and the suffering of many families across the planet, we also need international leadership. In this regard, it is essential that the United States and other great powers affirm international standards on enforced disappearances by ratifying the international convention and taking responsibility for abuses of their own, like the use of\u00a0<a class=\"bn-clickable\" href=\"https:\/\/www.thenation.com\/article\/cias-secret-sites-somalia\/\" target=\"_blank\" rel=\"nofollow noopener\" data-beacon=\"{&quot;p&quot;:{&quot;lnid&quot;:&quot;black sites&quot;,&quot;mpid&quot;:14,&quot;plid&quot;:&quot;https:\/\/www.thenation.com\/article\/cias-secret-sites-somalia\/&quot;}}\" data-beacon-parsed=\"true\">black sites<\/a>and secret detention centers, committed in the name of national security.<\/p>\n<\/div>\n<div class=\"content-list-component bn-content-list-text text\" data-beacon=\"{&quot;p&quot;:{&quot;mnid&quot;:&quot;citation&quot;}}\" data-beacon-parsed=\"true\">\n<p>There are few crimes as chilling as enforced disappearances. There is no closure for the families or loved ones, as hope mixes with fear. Families suffer and often find themselves without a breadwinner and difficulty obtaining any support or benefits (as they cannot prove the death of the one disappeared). Mixed with that hopelessness is the lawless nature of enforced disappearances, that can strike at any moment.<\/p>\n<\/div>\n<div class=\"content-list-component bn-content-list-text text\" data-beacon=\"{&quot;p&quot;:{&quot;mnid&quot;:&quot;citation&quot;}}\" data-beacon-parsed=\"true\">\n<p>It is, therefore, imperative in Syria and many other places that we find not only effective ways to support the families of the disappeared but also provide justice to the disappeared themselves. We do this by finding the truth about what happened to them, supporting the families and pursuing accountability for the perpetrators.
