Then imagine that your life is turned upside down for ten years by an international court, and your assets are frozen as they decide whether you\u2019re guilty of crimes against humanity. Then imagine you\u2019re acquitted and allowed to go. Now what? Do you get your assets back? No, they say. It\u2019s complicated. You then see no other alternative but to ask, like Jean-Pierre Bemba\u2019s lawyers did yesterday, March 11 in The Hague, 68 million in compensation to the International Criminal Court (ICC).<\/strong><\/p>\n<p><!--more--><\/p>\n<p>It might sound like the storyline of a bad thriller (dibs can be claimed to the author if \u2018Black Mirror\u2019 is interested). But this is real life at the international courts. Jean-Pierre Bemba, a former Congolese vice-president and erstwhile warlord has been trying, since he was acquitted of crimes against humanity and war crimes last year at the International Criminal Court (ICC), to get his assets back, and to pay his debts.<\/p>\n<h3>Bemba asks for a third of the ICC\u2019s budget\u2026<\/h3>\n<p>His lawyers Peter Haynes and Kate Gibson have gone back and forth with court\u2019s administrators and judges. But now, they\u2019ve up the ante and their client has <a href=\"https:\/\/www.icc-cpi.int\/Pages\/record.aspx?docNo=ICC-01\/05-01\/08-3663-Red\" target=\"_blank\" rel=\"noopener noreferrer\">filed for compensation<\/a>, saying \u201cthe Court acted negligently in seizing and freezing his property but failing properly to manage it or even account for it\u201d and asking for no less than 68.6 million EUR: 26.2 million for damages and legal costs and for 42.4 million for damage to his property. All told its more than a third of the court\u2019s annual budget. His lawyers allege the trial itself \u201cwas a parody of justice\u201d, citing a judgment \u201clittered with mistakes\u201d, the prosecution bringing \u201ca case it knew to be untrue\u201d and the way that the witness tampering case against Bemba and his first set of lawyers was handled by the judges \u201cremoved any objective appearance of fairness\u201d.<\/p>\n<h3>\u2026 to become \u201can ambassador for peace\u201d in CAR<\/h3>\n<p>But wait for the plot twist: \u201cHe proposes to give any compensation for losing ten years of his life, to victims in the Central African Republic (CAR),\u201d his lawyer Peter Haynes told JusticeInfo, \u201cto provide meaningful reparations for victims of this conflict\u2026 and become an ambassador for peace\u201d.<\/p>\n<p>It was back in May 2008, as the Congolese politician was being arrested, that Bemba\u2019s property and bank accounts in Belgium, Congo, and Portugal were frozen on orders from ICC judges. <a href=\"https:\/\/www.ijmonitor.org\/2018\/11\/bemba-seeks-to-have-his-assets-unfrozen-by-the-icc\/\" target=\"_blank\" rel=\"noopener noreferrer\">The property reportedly included<\/a> bank accounts in his own and his wife\u2019s name, their home in Brussels, a villa and a boat in Portugal. Other property seized but not frozen included six planes in Kinshasa, a couple more villas, a Boeing 727 aircraft and a river cruiser.<\/p>\n<p>Thijs Bouwknegt researcher at NIOD Institute and assistant professor at Amsterdam and Leiden universities, isn\u2019t too surprised by the extent of the ICC\u2019s haul \u2013 Bemba\u2019s father was very rich with <a href=\"https:\/\/www.vn.nl\/vonnis-valt-in-historisch-proces-tegen-heineken-partner-bemba\/\">reported<\/a> Heineken brewery connections. \u00a0In various court documents, many details are redacted. But there\u2019s enough detail in there to for most Hollywood directors.<\/p>\n<p>During the trial, the court\u2019s Registry, which deals with practical matters, <a href=\"https:\/\/www.icc-cpi.int\/Pages\/record.aspx?docNo=ICC-01\/05-01\/08-3651-Red\" target=\"_blank\" rel=\"noopener noreferrer\">was ordered by judges<\/a> to give an advance to Bemba\u2019s defence team \u2013 about EUR 30,000 a month - because he couldn\u2019t access his own frozen wealth. Later Bemba\u2019s lawyers said that their client was able to access some accounts and even cooperated with the court: in May 2014, \u20ac2 million was transferred to the Registry from Bemba\u2019s bank account in Cape Verde, which hadn\u2019t been frozen since the country wasn\u2019t an ICC member. Now his team point out that the court was required to properly manage other assets to preserve their value. If not for him, then for the victims who would have been paid if he were convicted.<\/p>\n<h3>Mr Bemba\u2019s assets? \u201cSimply allowed to rot\u201d<\/h3>\n<p>The ICC\u2019s own reports detailed by Bemba\u2019s lawyers show lack of clarity over details of the property, lack of expertise and lack of follow-up: they note that <a href=\"https:\/\/www.icc-cpi.int\/itemsDocuments\/ICC-Registry-CR.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">the ICC itself acknowledges<\/a> \u201coverlaps and inefficiencies and a lack of clarity as to internal processes when dealing with cooperation requests involving complex legal issues\u201d. \u201cMr Bemba\u2019s assets over a ten-year period were quite simply allowed to rot\u201d says Mr Haynes.<\/p>\n<p>Last November <a href=\"https:\/\/www.icc-cpi.int\/Pages\/record.aspx?docNo=ICC-01\/05-01\/08-3657-Red\" target=\"_blank\" rel=\"noopener noreferrer\">the judges rejected<\/a> Bemba\u2019s request to order Belgium, the Democratic Republic of Congo, and Portugal to simply unfreeze his assets. They also decided not to order the Registry to give Bemba all the information they have on his frozen assets. The Registry had argued the situation was \u201ccomplicated\u201d because Bemba owes the court money which had already been paid to his lawyer, and a EUR 300,000 fine for witness tampering. More juicy plot lines.<\/p>\n<p>So, does B have any chance realistically of getting compensation?<\/p>\n<p>First of all, as Bouwknegt notes, <a href=\"en\/tribunals\/icc\/39771-money-matters-at-the-icc.html\">at the ICC, money is tight<\/a>: \u201cThis comes a bit at a delicate and uncomfortable time, when judges are demanding more pay and better pension schemes, there are ongoing cases of damage claims [before the International Labour Organization] by former and current personnel over financial injury suffered from the ICC's reorganization, and then there is of course the Trust Fund for Victims that operates on a shoestring\u201d.<\/p>\n<p>Haynes though points to article 85 of the ICC\u2019s own statute: \u201cwhen this court was set up, it was set up knowing that it might have a liability to pay out sums to people who were wrongfully convicted or victims of miscarriages of justice\u2026if they haven\u2019t got insurance for this then frankly that is shockingly negligent\u201d.<\/p>\n<p>International justice commentator based at the university of Luxembourg, Owiso, says it\u2019s important to see the two aspects of the claim separately \u2013 firstly on the assets: \u201cInternational courts\/tribunals don't have a lot of useful experience dealing with frozen assets and management of assets generally\u201d and, \u201cthe secrecy and general lack of transparency with which the Registry has treated the question of Bemba's assets leaves a lot to be desired\u201d. So, depending on what the response is to that part of Bemba\u2019s claim, there could be a serious problem for the court.<\/p>\n<h3>\u201cUnlikely to succeed\u201d<\/h3>\n<p>But Owiso is more skeptical when it comes to a compensation claim about the trial and the provisional detention. Bemba would \u201chave to prove that his prosecution was malicious, and also perhaps that the trial chamber went along with it\u201d and considering that the appeals chamber has already said that \u201cthe trial chamber indeed misapprehended and misapplied the law\u201d but did not say \u201cthe trial chamber or the prosecution was out to maliciously convict Bemba\u201d, any claim for compensation, says Owiso, \u201cis unlikely to succeed\u201d.<\/p>\n<p>Bouwknegt agrees. \u201cAlthough in Dutch courts,\u201d he says, \u201cyou would actually make a big chance for some kind of reparation, even if it was only the fees for lawyers etc., if you were detained for a decade\u201d. But examples from other international courts are not encouraging. <a href=\"http:\/\/www.worldcourts.com\/ictr\/eng\/decisions\/2012.06.18_Zigiranyirazo_v_Prosecutor.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Rwandan businessman Protais Zigiranyirazo<\/a> (known as Mr. Z) was acquitted at the ICTR. He tried to argue that the court should give him a million dollars in compensation for detention time. <a href=\"en\/hirondelle-news\/24479-210612-ictrzigiranyirazo-judges-reject-zigiranyirazos-one-million-dollars-compensation-bid.html\">His claim was denied<\/a>. Former Rwandan minister Andre Rwamakuba, who was acquitted after eight years in detention also had his request for damages rejected (although he was awarded a small amount for a violation of his rights).<\/p>\n<h3>\u201cAfter Bemba, what are Gbagbo et Bl\u00e9 Goud\u00e9 going to demand?\u201d<\/h3>\n<p>And of course, there would be a potential domino effect says Bouwknegt: \u201cIf Bemba gets money, and if it is a lot, this will open up an expensive precedent at the ICC. What are [former Ivorian president] Gbagbo and [youth leader] Bl\u00e9 Goud\u00e9 going to demand if the appeals chamber upholds their acquittal?\u201d So, even if you\u2019re acquitted, even if you\u2019re allowed to leave the Hague, even if you declare yourself an ambassador for peace, it doesn\u2019t matter whether you\u2019re rich and powerful or not, in this thriller, there will be always be a plot twist.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Imagine you\u2019re a fabulously wealthy African politician: stocks, shares, businesses with your family and associates, money stashed all over the place, planes, boats and villas.
