Call the Swiss"},"content":{"rendered":"<p><strong>While the Dutch house international courts and support many transitional justice mechanisms around the globe, the Swiss offer the \u201cafter care\u201d services by attracting the world's leading archival experts and, more rarely, by housing certain sensitive archives in the vaults of the Swiss Federal Archives. <\/strong><\/p>\n<p><!--more--><\/p>\n<p>It\u2019s a huge challenge, says US archiving expert <a href=\"https:\/\/en.wikipedia.org\/wiki\/Trudy_Huskamp_Peterson\">Trudy Huskamp Peterson<\/a>, to get transitional justice mechanisms \u201cto recognize that when they end, there is a long-term life that has to be preserved for these records, that the utility of these records continues and sometimes becomes even more important over the long term\u201d. The other main challenge, she told Justice Info, is getting them to start thinking right from the beginning \u201cwho is going to take care of this stuff after they finish\u201d. Most often they do not think about it until the end, and then it\u2019s a scramble. In most cases \u201cit\u2019s risky to just leave all the records in the country because various governments come and go and they may not want evidence to continue to exist,\u201d she says.<\/p>\n<p>Thijs Bouwknegt, a Dutch transitional justice expert at the <a href=\"https:\/\/www.niod.nl\/en\">NIOD<\/a> Institute for War, Holocaust and Genocide Studies agrees that what is done is often \u201ctoo little too late\u201d. The NIOD is a public institution in the Netherlands that holds some important records related mainly but not exclusively to the Second World War. It has been involved in support for archiving\u00a0projects in other countries, such as digitizing the gacaca records in Rwanda.\u00a0The Netherlands is home to many important international courts and active in supporting transitional justice around the world but, according to Bouwknegt, generally less interested in \u201cafter care\u201d. It seems the Swiss have developed a strategy and a certain expertise in this domain.<\/p>\n<h3>Providing expertise<\/h3>\n<p>Amid various initiatives by national and regional governments, NGOs and others, Peterson says Switzerland is \u201cby far\u201d the country most active in this field. \u201cSwitzerland is a government that has long looked at dealing with the past. They have funded projects all over. In a big project on which I worked they almost totally funded the preservation of the nuclear claims tribunal records in the Marshall Islands. So, they have a long track record.\u201d<\/p>\n<p>Switzerland has a \u201c<a href=\"https:\/\/www.eda.admin.ch\/eda\/en\/home\/foreign-policy\/human-rights\/peace\/dealing-with-past.html\">Dealing with the Past<\/a>\u201d programme within the foreign ministry. Its taskforce coordinator Christian Schl\u00e4pfer says the ministry\u2019s \u201csystematic engagement in the area of Dealing with the Past goes back to around 2011 when our Taskforce was created\u201d. Activities involve providing expertise and sometimes acting as a safe haven for archives related to transitional justice. \u201cSwitzerland is receiving increasing numbers of requests to act as a safe haven for archives, but it takes a while to put a solution into practice, as complex legal and sometimes political considerations need to be take into account,\u201d he told Justice Info. \u201cProviding expertise, on the other hand, happens upon request by our partners and is much less resource-intensive.\u201d<\/p>\n<p>Since 2011 the foreign ministry has been working with the Swiss Federal Archives and the NGO Swisspeace on an \u201c<a href=\"http:\/\/archivesproject.swisspeace.ch\/\">Archives and Dealing with the Past<\/a>\u201d programme. Examples of its initiatives, according to Schl\u00e4pfer, include supporting a \u201csystem analysis and proposed solution for the management of the data\u201d collected by the Special Criminal Court in the Central African Republic; for the Extraordinary African Chambers in Senegal (Hiss\u00e8ne Habr\u00e9 trial) and Burundi Truth and Reconciliation Commission, supporting the safeguarding of the physical archives and their digitalization; and supporting the design of the data collection and archiving system for the Truth, Justice and Reconciliation Commission in Mali.<\/p>\n<figure><img decoding=\"async\" title=\"Archives data digital servers\" src=\"media\/archives-servers.jpg\" alt=\"Archives data digital servers\" \/><figcaption>Digital data storage<\/figcaption><\/figure>\n<h3>Swiss safe haven<\/h3>\n<p>As well as providing expertise, Schl\u00e4pfer told Justice Info that there are \u201cthree cases\u201d in which Switzerland holds transitional justice related archives from other countries for safekeeping. These include the archives of the <a href=\"https:\/\/en.wikipedia.org\/wiki\/Marshall_Islands_Nuclear_Claims_Tribunal\">Marshall Islands Nuclear Claims Tribunal<\/a> (NCT), which handled victim claims related to US nuclear testing. \u201cThese archives are still physically located on the islands but in very difficult climatic conditions - the general climatic conditions but also rising sea levels,\u201d says Schl\u00e4pfer. \u201cOriginally it started as digitizing these archives, with which we helped, and once they were digitized we managed to bring these digital copies to Switzerland and integrate them in the Federal Archives.\u201d<\/p>\n<p>The conditions of access to these archives are defined by the authorities of the Marshall Islands. In the other two cases, which Schl\u00e4pfer preferred not to disclose, he says it is \u201cmore a question of having a security copy somewhere in a safe space in case that's necessary\u201d, but there is no access to them. He told Justice Info they include police records that might be relevant for transitional justice purposes such as accountability or vetting. According to Peterson, the Swiss were \u201cvery important funders of the Guatemala Police Archives Project to try to <a href=\"http:\/\/archivesproject.swisspeace.ch\/news\/current-singleview\/article\/the-historic-archive-of-guatemalas-former-national-police\/\">preserve the police archives<\/a> in that country\u201d.<\/p>\n<h3>Neutrality gives credibility<\/h3>\n<p>Schl\u00e4pfer says Swiss initiatives in the field are part of government peace policy, since \u201cwe are generally engaged in supporting transitional justice processes\u201d and \u201cwe realized just how central archives actually are to these processes\u201d. \u201cWe\u2019ve noticed that the more useful they are, the more likely it is that they are at risk for whatever reason,\u201d he told Justice Info. \u201cThese risks can be environmental, as we saw, but also political, of course.\u201d<\/p>\n<p>Asked why countries might trust Switzerland with their sensitive archives, Schl\u00e4pfer says \u201cwe are not the only players in the field\u201d, but he thinks Switzerland has an advantage. \u201cIt\u2019s linked to our neutrality, and that we don\u2019t really have any stake, we\u2019re not suspected of having a stake, so that gives us more credibility. The other aspect, of course, is that we have made available some resources over quite some time for this type of activity.\u201d<\/p>\n<p>Schl\u00e4pfer says that in developing this \u201cniche\u201d, Switzerland has introduced an \u201capproach that resulted in <a href=\"https:\/\/www.ica.org\/en\/guiding-principles-for-safe-havens-for-archives-at-risk\">guiding principles<\/a>\u201d. When it acts as a government to safeguard transitional justice archives from another country, there is always a contract, otherwise \u201cthere are too many open questions\u201d, such as ownership and access to sensitive information. For example, \u201cthe records of both the Guatemala and El Salvador truth commissions are in the UN in New York\u201d and \u201cthe records of the truth commission of Liberia are in a <a href=\"https:\/\/repositories.lib.utexas.edu\/handle\/2152\/7110\">university in the United States<\/a>\u201d. The archives of the International Criminal Tribunal for former Yugoslavia are in the Netherlands, while those of the International Criminal Tribunal for Rwanda are in <a href=\"en\/tribunals\/ictr\/44008-rwanda-tribunal-residual-body-fails-to-catch-fugitives.html\">Tanzania<\/a> and remain accessible through the UN Residual Mechanism.<\/p>\n<p>Those of the Special Court for Sierra Leone (SCSL) are in the Netherlands, at the national archives, but remain the property of the <a href=\"http:\/\/www.rscsl.org\/\">SCSL Residual Mechanism<\/a>. Bouwknegt says this was a \u201crescue mission\u201d because \u201cpaper doesn\u2019t fare well in the Sierra Leone climate\u201d and they do not take up too much room. In the Netherlands, he says it is all about space, which is \u201cvery expensive in this country\u201d and can be a cause of friction over who pays for what.<\/p>\n<p>In terms of ownership and who pays for what, Peterson says she doesn\u2019t think this is a big issue for the UN tribunals because \u201cthey were created by the UN, they are UN records just as any other UN archives would be\u201d. But, she continues, \u201cwhen you have these joint bodies like in Cambodia, then we have real trouble figuring out who gets what, for what purpose and when\u201d. And so, she says, \u201cI really plead with these international bodies, these truth commissions, these tribunals.
