Current global efforts to prevent and reduce biodiversity loss focus on times of peace \u2014 but what about during armed conflict? <\/strong><\/p>\n<p><!--more--><\/p>\n<p>From the ravaging of <a href=\"https:\/\/wedocs.unep.org\/bitstream\/handle\/20.500.11822\/7656\/-Afghanistan_Post-conflict_environmental_assessment-2003afghanistan_post_conflict_environmental_assessment.pdf.pdf?sequence=3&amp;amp%3BisAllowed=\">Afghanistan's<\/a> forests to the damage inflicted on <a href=\"https:\/\/zoinet.org\/product\/five-years-of-fighting-in-eastern-ukraine-environmental-issues-depicted-in-infographics\/\">Ukraine\u2019s<\/a> protected areas to the decimation of wildlife across the <a href=\"https:\/\/www.sciencedirect.com\/science\/article\/abs\/pii\/S0006320713004540\">Democratic Republic of Congo<\/a>, armed conflicts continue to have a devastating impact on biodiversity worldwide. Biodiversity hotspots \u2014\u00a0the world\u2019s most <a href=\"https:\/\/www.cepf.net\/our-work\/biodiversity-hotspots\">species-rich yet threatened areas<\/a> \u2014 cover only <a href=\"https:\/\/www.conservation.org\/priorities\/biodiversity-hotspots\">2.4%<\/a> of Earth\u2019s land surface, but overlap strikingly with locations of armed conflicts historically. Between 1950 and 2000, <a href=\"https:\/\/pubmed.ncbi.nlm.nih.gov\/19236450\/\">over 90%<\/a> of major armed conflicts with more than 1,000 casualties occurred in countries containing biodiversity hotspots; more than 80% of these conflicts took place directly within hotspots.<\/p>\n<p>Armed conflict harms biodiversity in numerous ways: degrading forests, land, and natural resources; accelerating species loss; and impeding conservation efforts or research. The weakening or collapse of governance and easy access to weapons can facilitate poaching and the illegal wildlife trade, while civilian coping strategies and the effect of conflict-displaced peoples in need of basic sustenance can lead to the overexploitation of natural resources.<\/p>\n<h3>Addressing legal gaps<\/h3>\n<p>Although this toll is increasingly recognized, there is no special legal protection for biodiversity under international humanitarian law, which regulates how armed conflict is waged and lays out protections in order to limit its consequences. To date, most efforts to conserve biodiversity have focused on times of peace. Because key international biodiversity treaties, like the Convention on Biological Diversity and the Ramsar Convention, only apply in times of peace, important biodiversity areas \u2014 from hotspots to protected areas to indigenous territories \u2014 lack special legal protection during armed conflict.<\/p>\n<p>As the <a href=\"https:\/\/www.cbd.int\/gbo5\">global biodiversity crisis worsens<\/a>, recognition is growing of the importance of protecting biodiversity from the ravages of armed conflict. But little is known about how to do this, as <a href=\"https:\/\/www.gojil.eu\/issues\/101\/101_article_hsiao.pdf\">most related research<\/a> has focused solely on impacts to wildlife. (For example, in the vast Sahara-Sahel region, the escalation of armed conflicts over the last decade has driven <a href=\"https:\/\/conbio.onlinelibrary.wiley.com\/doi\/full\/10.1111\/conl.12446\">dramatic declines<\/a> of endangered local species; 12 of 14 large-sized vertebrates found in the region, such as Saharan cheetahs, Addax and Dama Gazelle, are now <a href=\"https:\/\/onlinelibrary.wiley.com\/doi\/10.1111\/ddi.12157\">listed<\/a> as \u201cExtinct in the Wild\u201d or globally threatened with extinction.)<\/p>\n<p>In recent years, these legal gaps have received increasing attention from the international community. The most significant development to date is the UN International Law Commission\u2019s (ILC) work to strengthen environmental protection before, during, and after armed conflict and during occupation. Given the ILC\u2019s mandate to codify and progressively develop international law, their adoption last year of twenty-eight <a href=\"https:\/\/legal.un.org\/ilc\/reports\/2019\/english\/chp6.pdf\">Draft Principles<\/a> are considered a <a href=\"https:\/\/www.gojil.eu\/issues\/101\/101_article_sjoestedt_dienelt.pdf\">starting point for the incremental shaping and developing<\/a> of law in this area.<\/p>\n<p>\u201cThe ILC\u2019s work carries huge symbolic value that the international community is addressing the topic,\u201d says Stavros Pantazopoulos, legal and policy analyst at the UK-based Conflict Environment Observatory.<\/p>\n<figure><img decoding=\"async\" title=\"African (Saharan) Cheetah\" src=\"media\/African-Saharan-Cheetah_Steve-Wilson.jpg\" alt=\"African (Saharan) Cheetah\" \/><figcaption>The Northwest African Cheetah (or \u00ab Saharan Cheetah \u00bb), lives mainly in the northwestern part of Africa (particularly the central western Sahara desert and the Sahel). It is classified as critically endangered, with a total world population estimated to be about 250 mature individuals. \u00a9 Steve Wilson<\/figcaption><\/figure>\n<h3>Designating \u201cprotected zones\u201d<\/h3>\n<p>The Draft Principles include designating areas of major environmental importance as \u201cprotected zones\u201d off limits for fighting and protected against any attack during armed conflict \u2014 as long as it does not contain a military objective. Given the legal gap for biodiversity, many experts consider such area-based protection a potentially important tool.<\/p>\n<p>Pantazopoulos considers the ILC\u2019s use of \u201cprotected zones\u201d \u2014 which share similarities with the concept of \u201c<a href=\"https:\/\/ihl-databases.icrc.org\/customary-ihl\/eng\/docs\/v2_rul_rule36\">demilitarized zones<\/a>\u201c in international humanitarian law\u2014 progressive. \u201cI see this as an appeal to conservationists through familiar terminology, it\u2019s not just the domain of military officials anymore.\u201d Also positive, Pantazopoulos adds, is the International Committee of the Red Cross including a similar recommendation to protect areas of ecological importance in their recently updated <a href=\"https:\/\/www.icrc.org\/en\/document\/guidelines-protection-natural-environment-armed-conflict-rules-and-recommendations-relating\">Guidelines on the Protection of the Natural Environment in Armed Conflict<\/a>. \u201cThey know the existing provisions are not sufficient and we need area-based protection.\u201d<\/p>\n<p>Jos\u00e9 Carlos Brito, a principal researcher at the University of Porto with extensive conservation experience in the Sahara-Sahel, welcomes the Draft Principles as a positive step forward, but says the requirement to designate \u201cprotected zones\u201d unnecessarily complicates things, and recommends the <a href=\"https:\/\/www.protectedplanet.net\/en\">World Database on Protected Areas<\/a> \u201cbe taken as a direct baseline for the protected zones.\u201d Giving blanket protection to all existing protected areas in the database would simplify the process, as states would not need to determine and designate which areas are worthy of further protection or not.<\/p>\n<p>When it comes to designation, Pantazopoulos thinks the international community would be more comfortable engaging in the protection of important biodiversity areas if they already enjoy international protection in peacetime through, for example, the World Heritage Convention or the Ramsar Convention. \u201cBecause these areas already have the consensus of the international community, it\u2019s easier for them to step in, or call on political parties to respect these areas.\u201d<\/p>\n<p><span style=\"boorder: 1px solid #ccc;\"><div class=\"articleLink articleLink--editorRecommanded articleLink--textInImage articleLink--textTop\" style=\"\">\r\n\t\t\t\t\t\r\n\t\t\t<div class=\"articleLinkSurTitle\">Recommended reading<\/div>\r\n\t\t\t<a class=\"articleLinkImageLink\" href=\"https:\/\/www.justiceinfo.net\/en\/45177-bled-by-armed-groups-congo-virunga-park-wants-justice.html\"><div class=\"articleLinkImageContainer \"><img loading=\"lazy\" decoding=\"async\" width=\"540\" height=\"360\" src=\"https:\/\/www.justiceinfo.net\/wp-content\/uploads\/9136edfb8144a0445fced5338199d50e-540x360.jpg\" class=\"articleLinkImage backgroundImageTag w-100 wp-post-image\" alt=\"\" srcset=\"https:\/\/www.justiceinfo.net\/wp-content\/uploads\/9136edfb8144a0445fced5338199d50e-540x360.jpg 540w, https:\/\/www.justiceinfo.net\/wp-content\/uploads\/9136edfb8144a0445fced5338199d50e-730x487.jpg 730w, https:\/\/www.justiceinfo.net\/wp-content\/uploads\/9136edfb8144a0445fced5338199d50e-1110x740.jpg 1110w, https:\/\/www.justiceinfo.net\/wp-content\/uploads\/9136edfb8144a0445fced5338199d50e.jpg 1200w\" sizes=\"auto, (max-width: 540px) 100vw, 540px\" \/><\/div><\/a>\r\n\t\t\t<a href=\"https:\/\/www.justiceinfo.net\/en\/45177-bled-by-armed-groups-congo-virunga-park-wants-justice.html\" class=\"articleLinkTitle articleLinkTitle--default\">\r\n\t\t\tBled by armed groups, Congo\u2019s Virunga Park wants justice\r\n\t\t<\/a>\r\n\t\t\r\n\t\t\t\t<\/div><\/span><\/p>\n<h3>The \u201cmilitarization of conservation\u201d<\/h3>\n<p>But while designating an area as a protected zone is one thing, implementing and upholding protection during armed conflict is another. Whether the good intent of the Draft Principles can translate into real protection on the ground hinges on if the commitment required is there, says Brito. \u201cParties may be strictly focused on the achievement of the military objectives and the protection of the environment \u2018forgotten.\u2019\u201d<\/p>\n<p>Then there are the risks, which experts argue merit further scrutiny.<\/p>\n<p>Some experts are concerned area-based conservation could lead to the \u201cmilitarization of conservation\u201d\u2014 deploying militarized techniques in order to protect the protected zones \u2014 which has come under increased criticism in recent years, after <a href=\"https:\/\/www.buzzfeednews.com\/collection\/wwfsecretwar\">evidence emerged<\/a> of human rights abuses committed in the name of conservation across <a href=\"https:\/\/news.mongabay.com\/2019\/03\/local-communities-feared-repression-from-wwf-investigation-finds\/\">six countries in Africa and Asia<\/a>. The debate surrounding it is \u201cvery legitimate and very divisive in the conservation world,\u201d says Elaine Hsiao, research fellow at the UK\u2019s Sheffield Institute for International Development. \u201cConservation is still struggling to find that non-violent alternative they need that can make it successful in the long-run.\u201d<\/p>\n<p>Many conservationists are <a href=\"https:\/\/www.sciencedirect.com\/science\/article\/pii\/S0006320718313454\">against<\/a> militarized approaches; others, like Brito, reluctantly accept that, however imperfect, the circumstances necessitate them. \u201cAlthough as a baseline I reject any form of armed solution\u2026under the context of armed conflict it's almost impossible to ensure environmental protection\u00a0without some sort of militarization.\u201d<\/p>\n<h3>The missing voice of local communities<\/h3>\n<p>A related concern is that area-based protection could lead to \u201c<a href=\"https:\/\/www.mdpi.com\/2073-445X\/9\/3\/65\">fortress conservation<\/a>\u201d \u2014 an approach rooted in the belief that ecosystems function best in isolation from humans \u2014 which has been critiqued for <a href=\"https:\/\/www.corneredbypas.com\/\">vilifying and excluding local and indigenous communities<\/a> who sustainably managed and protected their natural environments long-before modern conservation existed.<\/p>\n<p>Because the Draft Principles are designed to address challenges at the State-level they do not include non-State actors, like local communities or indigenous peoples, as parties to an agreement. This is a common issue and just one of the challenges of addressing these kinds of situations through international law, explains Hsiao. \u201cYou\u2019re trying to take a localized context with actors on the ground and create a high-level law that\u2019s supposed to apply. Sometimes, it\u2019s like law-making at the wrong level.\u201d<\/p>\n<p>Hsiao thinks the hyper-focus on protected areas averts attention from where it might be more important: indigenous territories and community-conserved areas, which are <a href=\"https:\/\/www.iccaconsortium.org\/index.php\/discover\/\">essential to conservation<\/a> because of how much land they encompass. \u201cI don\u2019t think the Draft Principles provide strong enough or appropriately framed protection for those kinds of spaces.\u201d<\/p>\n<h3>The limits of sensitization<\/h3>\n<p>Since biodiversity protection comes down to the responsibility of the actors of the armed conflict, environmental education is critical, says Brito. \u201cThose engaged in military action need to understand the intrinsic value that ecosystem services provide to humankind.\u201d<\/p>\n<p>Accordingly, Hsiao thinks conservationists need to be trained in negotiation and conflict transformation with armed actors. Some work is being done to <a href=\"https:\/\/www.icrc.org\/en\/document\/guidelines-protection-natural-environment-armed-conflict-rules-and-recommendations-relating\">sensitize militaries<\/a> around how to protect the environment in times of armed conflict, but when it comes to non-State actors, she explains, engagement often happens ad-hoc and is not spoken of openly because \u201cit\u2019s not seen positively that you\u2019d engage with armed actors, especially non-State armed groups.\u201d<\/p>\n<p>Involving the arms industry by introducing a compensation mechanism for environmental protection \u2014 similar to those used in relation to natural resource extraction\u2014 could be a novel way to hold the arms industry accountable for the damage caused by the goods they produce, says Brito.<\/p>\n<p>It remains to be seen whether legal efforts can actually enhance protection on the ground. But with biodiversity in free fall globally, declining <a href=\"https:\/\/ipbes.net\/sites\/default\/files\/2020-02\/ipbes_global_assessment_report_summary_for_policymakers_en.pdf\">faster<\/a> than at any other moment in human history, reducing armed conflict\u2019s toll on the web of life has never been more urgent.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>November 6 is the International Day for Preventing the\u00a0Exploitation of the Environment in War and Armed Conflict.
