Instead, phoenix-like, it\u2019s slimmed down, raised some cash and will be holding appeals hearings in early October in its only adjudicated case. But donors will not allow more than that.<\/strong><\/strong><\/p>\n\n\n\n<!--more-->\n\n\n\n<p>It\u2019s been an eventful twelve months for the <a href=\"https:\/\/www.justiceinfo.net\/en\/44825-special-tribunal-for-lebanon-billion-dollar-trial.html\">Special Tribunal for Lebanon (STL)<\/a>. In August 2020 the Hague-based judges of this hybrid tribunal pronounced their verdict in the only case this court has brought to trial. They said one person, Hezbollah operative Mohamed Ayyash was guilty of the car bomb that killed former Lebanese Prime Minister Rafik Hariri in 2005, while the other three accused were acquitted. <a href=\"https:\/\/www.justiceinfo.net\/en\/46418-special-tribunal-for-lebanon-the-mountain-that-gave-birth-to-a-mouse.html\">In December Ayyash was sentenced to life imprisonment<\/a> for each of the five counts of which he had been found guilty.<\/p>\n\n\n\n<p>The judgment was weighty - two thousand six hundred forty-one pages - full of historical and forensic detail, analysing around 300 witnesses and 170,000 pages of evidence gathered over a period of fifteen years since the first international investigation into Hariri\u2019s murder was sent to Lebanon. The judgment helped to set an historical record of how the Lebanese state was deliberately destabilised. Yet it could be overturned at any point.<\/p>\n\n\n\n<p>Ayyash, like all the accused in the case, has never appeared in court, and if an in-person trial was organised rather than the twelve years of in absentia hearings already held, the ruling would not stand.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">And then it crashed<\/h2>\n\n\n\n<p>Last March the United Nations authorised another two years on the tribunal\u2019s clock. The court\u2019s own <a href=\"https:\/\/www.stl-tsl.org\/crs\/assets\/Uploads\/20210619-F3865-PUBLIC-COR-Reg-Updated-Notice-Purs-48C-Shortfall-Funding-EN-Web.pdf\">documents<\/a> said it was costing \u201caround 2.8 million euros per month\u201d at this point. The STL\u2019s <a href=\"https:\/\/www.stl-tsl.org\/sites\/default\/files\/documents\/annual-reports\/STL_12th_Annual_Report-EN.pdf\">annual report<\/a> was preceded by the president Ivana Hrdli\u010dkov\u00e1 proudly describing the organisation a \u201csmart, lean and adaptable institution\u201d - after some restructuring.<\/p>\n\n\n\n<p><a href=\"https:\/\/www.justiceinfo.net\/en\/78159-inglorious-end-lebanon-tribunal.html\">Then in June came the crash<\/a>. Just as the court was gearing up to start a second trial, against the same Ayyash and again in absentia, it\u00a0suddenly <a href=\"https:\/\/www.stl-tsl.org\/en\/media\/press-releases\/severe-financial-crisis-threatens-the-stls-ability-to-fulfil-its-mandate\">announced<\/a> that it was \u201cfacing an unprecedented financial crisis\u201d and would have to shut by the end of July this year. It didn\u2019t even have the resources to complete the appeal phase of its first trial, let alone start a new one. It would be forced to lay off staff and work on \u201cdraw down activities\u201d alone. In Beirut the predicted demise of the court caused barely a ripple. Between national economic collapse and <a href=\"https:\/\/www.hrw.org\/report\/2021\/08\/03\/they-killed-us-inside\/investigation-august-4-beirut-blast\">efforts to get an international investigation<\/a> into who should be held accountable for Lebanon\u2019s biggest blast \u2013 the Beirut harbour explosion in August 2020 \u2013 the financial travails of an institution detailing distant history seemed remote. As the victims representative in the STL first case, Peter Haynes, points out, despite \u201csome good moments\u201d in the judgment, when judges specifically referred to reparations, \u201cultimately nobody paid, and nobody was compensated\u201d. It took so long that \u201csome victims actually died during the process\u201d, he says.<\/p>\n\n\n\n<p>Before December last year, some 450 people were working at the court. Outreach was cut that month. Several waves of staff have been let go. More left in July including legal aid staff. Currently there are 132 employees and there will be \u201canother significant reduction\u201d before the end of the year, says Wajed Ramadan, the court\u2019s spokesperson.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">No buy-in for additional trials<\/h2>\n\n\n\n<p>The substantial shortfall, and the unwillingness of donors to supply the STL with anything more than the basic necessities \u201cto avoid a rapid and disorderly shutdown of the Tribunal's operations,\u201d according to the <a href=\"https:\/\/www.stl-tsl.org\/crs\/assets\/Uploads\/20210619-F3865-PUBLIC-COR-Reg-Updated-Notice-Purs-48C-Shortfall-Funding-EN-Web.pdf\">registrar\u2019s filings<\/a>, acted as a brake on any further aspirations the court may have had to conduct more trials. The registrar informed the judges that donors wanted \u201ca detailed drawdown plan, detailing staffing and other costs, as well as a clear timeline for completion\u201d. In fact, some funds have been conditionally pledged \u201con the explicit condition that it be used for draw down activities only\u201d. That would include witness protection and storing sensitive materials. Staff who have now left, seem phlegmatic: \u201cIt was bound to happen one day,\u201d said one who wanted to remain anonymous.<\/p>\n\n\n\n<p>But now the latest twist is that some funds have been secured, and a <a href=\"https:\/\/www.stl-tsl.org\/crs\/assets\/Uploads\/20210910-F0041-A2-PUBLIC-AC-Revised-Sched-Order-App-Hear-EN-Web.pdf\">five-day appeals hearing<\/a> in the first case will be held on October 4-8. The prosecutor is appealing against the not guilty verdict for three of the accused. It will be the first time this chamber will be ruling on substantive issues, rather than procedural matters. The STL Registrar David Tolbert told Justice Info that although they had \u201clost a lot of staff\u201d and that the tribunal remains in a \u201cvery difficult situation\u201d, it\u2019s now in a \u201cbetter situation\u201d than back in June.<\/p>\n\n\n\n<p>\u201cObviously having the appeal was very important, to close the case,\u201d says Tolbert. Donors were convinced of the necessity to provide funds for this. But there was \u201cno buy-in for further proceedings,\u201d says Tolbert. The planned second case, which dealt with three other car bombings, known as the \u2018connected cases\u2019 under the court\u2019s statute, targeting other prominent Lebanese leaders, should be considered in permanent limbo. Once the appeals\u2019 process in the Hariri trial is completed, the tribunal will become, according to a letter to staff, \u201ca dormant entity\u201d.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">\u201cEnough to get us through\u201d<\/h2>\n\n\n\n<p>So does the court now have enough to finish what it started, and to close in a more dignified manner? \u201cI can say it\u2019s enough to get us through,\u201d says Tolbert. In their August letter to staff members explaining how the court will be continuing, STL principals said they had secured seven million euros. Wajed Ramadan clarifies the figures: \u201cAs per the 2021 revised budget, approved by the Management Committee on 19 July 2021, the Tribunal requires \u20ac5.7 million for the period from 1 August \u2013 31 December 2021. The 2022 Budget, approved by the [Management Committee] on 23 August 2021, is for \u20ac7 million. It includes the core activities such as the Appeals \u2026 as well as transitioning to a dormant entity.\u201d<\/p>\n\n\n\n<p>It\u2019s not known which countries have contributed: \u201cMostly traditional donors\u201d says Tolbert, meaning the&nbsp;<a href=\"https:\/\/www.stl-tsl.org\/en\/about-the-stl\/oversight\" target=\"_blank\" rel=\"noreferrer noopener\">STL Management Committee<\/a>&nbsp;\u2013 which includes representatives of Lebanon, the Netherlands, the United Kingdom (Chair), Canada (Vice-Chair), France, Germany, Italy, Japan, the United States and the European Union \u2013 \u201csufficient\u201d numbers of them, he says, but \u201cnot everyone\u201d. The UK is known to have taken a hard line on putting more funding in. But the Management Committee stuck jointly to the requirement that the court only be given a very narrow window of funds leading explicitly to a wrap-up of all activities as expeditiously as possible.<\/p>\n\n\n\n<p>Donors have become unwilling to allow more. \u201cIt all just took too long and the international community lost patience,\" says Haynes. Former staff talk of how \u201cthere needed to be tough decisions made on staffing way earlier\u201d. \u201cManagement has stalled making tough decisions,\u201d says one insider who preferred not to be named.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Bringing it to dormancy<\/h2>\n\n\n\n<p>How to close the tribunal is now Tolbert\u2019s focus.
