Six months into his new reign, we try to read the tea leaves and understand the new direction the Office of the Prosecutor is taking.<\/p>\n\n\n\n<p>His predecessor Fatou Bensouda left tonnes of unfinished business on his plate, including new investigations with no funding like Ukraine and Nigeria, plus lots of preliminary examinations, some of which have gone on for decades.<\/p>\n\n\n\n<p>The big decision has been <a href=\"https:\/\/www.justiceinfo.net\/en\/83498-afghanistan-war-of-position-icc.html\">Afghanistan<\/a> where <a rel=\"noreferrer noopener\" href=\"https:\/\/www.icc-cpi.int\/Pages\/item.aspx?name=2021-09-27-otp-statement-afghanistan\" target=\"_blank\">the prosecutor has said<\/a> that he has decided to focus his \u201cOffice\u2019s investigations in Afghanistan on crimes allegedly committed by the Taliban and the Islamic State \u2013 Khorasan Province (\u201cIS-K\u201d) and to deprioritise other aspects of this investigation\u201d.&nbsp;<\/p>\n\n\n\n<p>For a great summary \u2013 and challenge over legality of his move \u2013 from one of the victims representatives in this situation at the ICC, <a rel=\"noreferrer noopener\" href=\"http:\/\/opiniojuris.org\/2021\/11\/26\/limits-to-prosecutorial-discretion-the-icc-prosecutors-deprioritisation-decision-in-afghanistan\/\" target=\"_blank\">check this piece out by Nada Kiswanson at Opinio Juris<\/a>.<\/p>\n\n\n\n<p>Other developments are closing the preliminary examination in <a href=\"https:\/\/www.justiceinfo.net\/en\/84121-icc-backs-colombia-transitional-justice-model.html\">Colombia<\/a> and opening one in <a href=\"https:\/\/www.justiceinfo.net\/en\/84481-venezuela-icc-who-is-fooling-who.html\">Venezuela<\/a>. Triestino Marinello of Liverpool\u2019s John Moores University, says the prosecutor\u2019s new agreement with Caracas is very much in line with what Khan laid out beforehand to states \u2013 that it\u2019s the states role to prosecute \u2013 positive complementarity. But he says the MOU has no legal value and undermines the Rome Statute.<\/p>\n\n\n\n<p>And Khan has <a href=\"https:\/\/media.un.org\/en\/asset\/k10\/k106hg9ys6\" target=\"_blank\" rel=\"noreferrer noopener\">appeared for the first time at the United Nations Security Council to talk about Libya<\/a>. Sudan Darfur was also referred by the UN, but trials are going nowhere with a new military in charge in Khartoum. As for Libya , Khan told the Security Council to pay up for the court\u2019s work, because it\u2019s strapped for cash.<\/p>\n\n\n\n<p>Chantal Meloni, who advises ECCHR, has <a rel=\"noreferrer noopener\" href=\"https:\/\/www.ecchr.eu\/fileadmin\/Publikationen\/NO_WAY_OUT_Migrants_and_refugees_trapped_in_Libya_face_crimes_against_humanity_EN.pdf\" target=\"_blank\">a new report on Libya<\/a> together with FIDH and Lawyers for Justice in Libya. They say there\u2019s evidence of crimes against humanity against hundreds of migrants from Africa and the Middle East who are stuck in Libya trying to get across the Mediterranean to Europe.&nbsp;The trafficking is very close to slavery, and it\u2019s fuelling the armed conflict, they say. Will the prosecutor turn his attention that way too?<\/p>\n\n\n\n<p>So, coming into the ASP, are we facing a paradigm shift with this new prosecutor? Is he now closer to states? Judges have warned him that he can\u2019t just be impartial but also has to give the appearance of impartiality.
