L\u2019Etat ivoirien a jusqu\u2019au 10 octobre pour d\u00e9poser cet argumentaire additionnel.<\/p>\n<p><!--more--><\/p>\n<p>Sous le coup d\u2019un mandat d\u2019arr\u00eat de la CPI, l\u2019ancienne premi\u00e8re dame est toujours d\u00e9tenue \u00e0 Abidjan alors que son mari, Laurent Gbagbo, se trouve d\u00e9j\u00e0 au centre de d\u00e9tention de la Cour, \u00e0 La Haye, aux Pays-Bas.L\u2019Etat ivoirien soutient, dans sa requ\u00eate, qu\u2019une proc\u00e9dure judiciaire est en cours devant la justice nationale contre l\u2019\u00e9pouse de l\u2019ancien pr\u00e9sident.Dans sa d\u00e9cision de jeudi, la CPI demande \u00e0 Abidjan de prouver que le dossier en cours devant la justice ivoirienne \u00ab refl\u00e8te suffisamment l\u2019affaire devant la Cour \u00bb internationale qui veut \u00eatre inform\u00e9e \u00ab des contours et de l\u2019\u00e9tat actuel de la proc\u00e9dure interne \u00bb.La CPI a \u00e9t\u00e9 con\u00e7ue pour compl\u00e9ter les syst\u00e8mes judiciaires nationaux : elle ne peut donc exercer sa comp\u00e9tence que lorsque les juridictions nationales n\u2019ont pas la volont\u00e9, la comp\u00e9tence et la capacit\u00e9 n\u00e9cessaires pour juger un suspect.Le Statut de Rome, texte fondateur de la CPI, pr\u00e9voit ainsi la possibilit\u00e9, pour un Etat, de contester la recevabilit\u00e9 d\u2019une affaire devant la Cour internationale, lorsqu\u2019une proc\u00e9dure nationale concernant les m\u00eames faits et la m\u00eame personne est en cours.La d\u00e9cision finale revient aux juges de la CPI.Simone Gbagbo et son \u00e9poux ont \u00e9t\u00e9 arr\u00eat\u00e9s \u00e0 Abidjan le 11 avril 2011par les forces de leur adversaire, l\u2019actuel pr\u00e9sident Alassane Ouattara.Le 29 f\u00e9vrier 2012, la CPI a \u00e9mis \u00e0 l\u2019encontre de Simone Gbagbo un mandat d\u2019arr\u00eat d\u2019abord class\u00e9 sous scell\u00e9s, puis rendu public en novembre de la m\u00eame ann\u00e9e.Elle est suspect\u00e9e de crimes contre l\u2019humanit\u00e9, dont\u00a0 meurtres, viols, pers\u00e9cution et autres actes inhumains.Comme dans le cas de son mari d\u00e9j\u00e0 entre les mains de la CPI, il s\u2019agit de crimes commis en C\u00f4te d\u2019Ivoire entre le 16 d\u00e9cembre 2010 et le 12 avril 2011.ER<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Arusha, 29 ao\u00fbt 2014 (FH) \u2013 La Cour p\u00e9nale internationale (CPI) a rendu jeudi une d\u00e9cision invitant les autorit\u00e9s ivoiriennes \u00e0 d\u00e9poser des observations suppl\u00e9mentaires en appui \u00e0 leur demande de juger devant leurs tribunaux Simone Gbagbo, l\u2019\u00e9pouse de l\u2019ancien pr\u00e9sident.
