Dans une d\u00e9cision potentiellement d\u00e9cisive, les juges de la Cour p\u00e9nale internationale consid\u00e8rent que les crimes commis contre les Rohingyas de Birmanie rel\u00e8vent de sa comp\u00e9tence.<\/strong><\/em><\/p>\n

Dans un contexte de grande tension entre la Birmanie et l'ONU, la Cour p\u00e9nale internationale (CPI) s'est d\u00e9clar\u00e9e jeudi comp\u00e9tente pour enqu\u00eater sur la d\u00e9portation de la minorit\u00e9 musulmane rohingya, qui pourrait constituer un crime contre l'humanit\u00e9.<\/p>\n

En 2017, plus de 700.000 musulmans rohingyas ont fui la Birmanie, majoritairement bouddhiste, apr\u00e8s une offensive de l'arm\u00e9e en repr\u00e9sailles d'attaques de postes-fronti\u00e8res par des rebelles rohingyas.<\/p>\n

Pers\u00e9cut\u00e9s par les forces arm\u00e9es birmanes et des milices bouddhistes, les membres de la minorit\u00e9 musulmane se sont r\u00e9fugi\u00e9s dans d'immenses campements de fortune au Bangladesh.<\/p>\n

\"La CPI d\u00e9cide que la Cour peut exercer sa comp\u00e9tence \u00e0 l'\u00e9gard de la d\u00e9portation all\u00e9gu\u00e9e du peuple rohingya du Myanmar (Birmanie, ndlr) au Bangladesh\", d\u00e9clare dans un communiqu\u00e9 la Cour bas\u00e9e \u00e0 La Haye.<\/p>\n

Selon M\u00e9decins sans fronti\u00e8res (MSF), au moins 6.700 Rohingyas ont \u00e9t\u00e9 tu\u00e9s entre ao\u00fbt et septembre 2017 au cours d'une vague de r\u00e9pressions qualifi\u00e9e par l'ONU de \"nettoyage ethnique\", et m\u00eame de \"g\u00e9nocide\".<\/p>\n

L'annonce de la Cour, cr\u00e9\u00e9e pour juger les pires atrocit\u00e9s commises dans le monde, intervient dans un contexte de grande tensions entre la Birmanie et la communaut\u00e9 internationale.<\/p>\n

Des enqu\u00eateurs de l'ONU ont demand\u00e9 fin ao\u00fbt que la justice internationale poursuive le chef de l'arm\u00e9e birmane et cinq autres hauts grad\u00e9s pour \"g\u00e9nocide\", \"crimes contre l'humanit\u00e9\" et \"crimes de guerre\" \u00e0 l'encontre des musulmans rohingyas. Des accusations rejet\u00e9es par les autorit\u00e9s birmanes.<\/p>\n

\"Crimes \u00e9pouvantables\"\u00a0<\/h3>\n

Le ministre britannique des Affaires \u00e9trang\u00e8res, Jeremy Hunt, a d\u00e9clar\u00e9 mardi vouloir convoquer une \"r\u00e9union de haut niveau\" aux Nations unies sur les massacres de Rohingyas, estimant que les responsables devaient \u00eatre traduits en justice.<\/p>\n

\"Le nettoyage ethnique sous quelque forme que ce soit, o\u00f9 qu'il se passe, ne devrait jamais rester impuni et les auteurs de ces crimes \u00e9pouvantables doivent \u00eatre traduits en justice\", a-t-il poursuivi.<\/p>\n

Deux reporters birmans de Reuters accus\u00e9s d'avoir port\u00e9 \"atteinte au secret d'Etat\" pour avoir enqu\u00eat\u00e9 sur un massacre de Rohingyas par l'arm\u00e9e en Birmanie ont \u00e9t\u00e9 condamn\u00e9s lundi \u00e0 sept ans de prison, au terme d'un proc\u00e8s qui a entach\u00e9 un peu plus l'image de la dirigeante birmane Aung San Suu Kyi.<\/p>\n

Arriv\u00e9e au pouvoir en 2016, l'ancienne dissidente n'a pas pris la parole sur les pers\u00e9cutions des Rohingyas, soucieuse de maintenir le statu quo avec une arm\u00e9e toujours puissante.<\/p>\n

En avril, le procureur de la CPI Fatou Bensouda a demand\u00e9 aux juges l'ouverture d'une enqu\u00eate pr\u00e9liminaire pour d\u00e9terminer si les d\u00e9portations relevaient d'un crime contre l'humanit\u00e9.<\/p>\n

La requ\u00eate \u00e9tait juridiquement complexe car la Birmanie n'est pas signataire du Statut de Rome, trait\u00e9 fondateur de la CPI.<\/p>\n

La CPI s'est d\u00e9clar\u00e9e comp\u00e9tente \"puisqu'un \u00e9l\u00e9ment du crime, le passage d'une fronti\u00e8re, a eu lieu sur le territoire d'un \u00c9tat partie, le Bangladesh\", a poursuivi la Cour.<\/p>\n

Le gouvernement birman a refus\u00e9 jeudi de commenter cette annonce apr\u00e8s avoir \u00e9t\u00e9 contact\u00e9 par l'AFP.<\/p>\n
