Justice Minister Marco Buschmann told the press this was to \\u201ccollect and secure all the evidence\\u201d with a view to possible future prosecutions under <a href=\\\"https:\\\/\\\/www.justiceinfo.net\\\/en\\\/tribunals\\\/universal-jurisdiction\\\" target=\\\"_blank\\\">universal jurisdiction<\\\/a>. The aim is to \\u201cdetermine the criminal nature\\u201d of Russia\\u2019s invasion of Ukraine, the office said in a statement. Like Germany, Spain has repeatedly prosecuted atrocities committed abroad using the legal principle of <a href=\\\"https:\\\/\\\/www.justiceinfo.net\\\/en\\\/tribunals\\\/universal-jurisdiction\\\" target=\\\"_blank\\\">universal jurisdiction<\\\/a>.<\\\/p>\"},\"marker-4\":{\"title\":\"Estonia : Baltic solidarity\",\"text\":\"<p>As early as March 8, and then on March 20 on Twitter, the Prosecutor General of Ukraine, Iryna Venediktova, cited Estonia as one of the countries that had opened an investigation into war crimes committed in Ukraine. On February 28, 2022, following the Russian invasion, Prosecutor Karim Khan announced that he was <a href=\\\"https:\\\/\\\/www.justiceinfo.net\\\/en\\\/88144-icc-historic-state-referrals-accelerates-opening-investigation-ukraine.html\\\" target=\\\"_blank\\\">opening a full investigation<\\\/a>. As to date, the case was referred to the Prosecutor by an unusual <a href=\\\"https:\\\/\\\/www.justiceinfo.net\\\/en\\\/88144-icc-historic-state-referrals-accelerates-opening-investigation-ukraine.html\\\" target=\\\"_blank\\\">41 member countries<\\\/a>. Based in The Hague, Netherlands, the ICC can prosecute individuals for war crimes, crimes against humanity and genocide. It cannot prosecute the \\u201c<a href=\\\"https:\\\/\\\/www.justiceinfo.net\\\/en\\\/88144-icc-historic-state-referrals-accelerates-opening-investigation-ukraine.html\\\" target=\\\"_blank\\\">crime of aggression<\\\/a>\\u201d in the Ukraine case, as neither Russia nor Ukraine are States Parties (members) of the Court. Ukraine recognised the ICC\\u2019s jurisdiction following the Russian annexation of Crimea in 2014<br \\\/><br \\\/><a href=\\\"https:\\\/\\\/www.justiceinfo.net\\\/en\\\/tribunals\\\/icc\\\" target=\\\"_blank\\\">All our article about the ICC<\\\/a>.<\\\/p>\"},\"marker-6\":{\"title\":\"International Court of Justice (ICJ)\",\"text\":\"<p>On February 27, 2022, Ukraine brought a case against Russia at the ICJ under the 1948 Genocide Convention. It argues that Russia has misused and violated the Convention by falsely claiming that Ukraine committed genocide in the eastern Donbass region and using this as a pretext to invade. Based in The Hague, Netherlands, the ICJ is the UN\\u2019s highest court. It rules on disputes between states, based on international treaties and conventions. It cannot prosecute individuals. Cases before the ICJ usually take years, but Ukraine asked the court to take \\u201cprovisional measures\\u201d, which it did on March 16, <a href=\\\"https:\\\/\\\/www.justiceinfo.net\\\/en\\\/88936-international-court-of-justice-orders-russia-stop-invasion-ukraine.html\\\" target=\\\"_blank\\\">ordering Russia to immediately suspend its military operations<\\\/a>. ICJ rulings are binding, but it has no enforcement mechanism.<\\\/p>\"},\"marker-7\":{\"title\":\"European Court of Human Rights (ECHR)\",\"text\":\"<p>On February 28, <a href=\\\"https:\\\/\\\/www.justiceinfo.net\\\/en\\\/90187-ukraine-russia-european-court-of-human-rights-can-do.html\\\" target=\\\"_blank\\\">Ukraine filed an application against Russia at the ECHR<\\\/a> on grounds of \\u201cmassive human rights violations being committed by the Russian troops in the course of the military aggression\\u201d, and requesting the court to take interim measures. The ECHR did this the following day, on March 1, calling on the Russian government to \\u201crefrain from military attacks against civilians and civilian objects\\u201d as well as other violations of international humanitarian law. Based in Strasbourg, France, the ECHR (not to be confused with the Court of Justice of the European Union in Luxembourg) rules on individual or state applications alleging violations of the European Convention on Human Rights, which Russia and Ukraine have both ratified. It rules on compliance by states and government authorities, not individuals, although it can take cases filed by both individuals and states. The Court\\u2019s decisions are binding, but it has no enforcement mechanism.<\\\/p>\"},\"marker-8\":{\"title\":\"UN Human Rights Council (UNHRC)\",\"text\":\"<p>The Human Rights Council, based in the Swiss city of Geneva, overwhelmingly approved on March 4 a resolution brought by Ukraine condemning the Russian invasion, calling for the withdrawal of Russian troops and setting up a three-member commission of inquiry into violations of human rights and international humanitarian law in Ukraine. The commission of inquiry has a one-year mandate to collect and preserve evidence for \\u201cfuture legal proceedings\\u201d. Only Russia and Eritrea voted against the resolution, while 32 states voted in favour and 13 abstained. The Human Rights Council is composed of UN member states and is not a court. As Russia was accused of abuses in Ukraine, on April 7 <a href=\\\"https:\\\/\\\/www.justiceinfo.net\\\/en\\\/90276-russia-kicked-off-un-rights-council-over-ukraine-abuses.html\\\" target=\\\"_blank\\\">the UN excluded it from the Human Rights Council<\\\/a>.<\\\/p>\"},\"marker-9\":{\"title\":\"Ukraine\\u2019s Prosecutor General Office (UPGO)\",\"text\":\"<p>The office of Ukraine\\u2019s Prosecutor General has been investigating serious Russian crimes since the invasion of Crimea in 2014. After the full invasion attempt started on February 24, it extended its investigations. As of March 23, it said it had recorded 2,401 \\\"<a href=\\\"https:\\\/\\\/www.justiceinfo.net\\\/en\\\/91135-nuremberg-russia-crime-of-aggression.html\\\" target=\\\"_blank\\\">crimes of aggression<\\\/a> and war crimes\\\" and 1,516 \\\"crimes against national security\\\" in the first month of conflict. There are 127 \\\"wanted\\\" suspects in what it says is the \\\"anchor case\\\" against Russia\\u2019s civil and military regime. Prosecutor Iryna Venediktova has been travelling the length and breadth of unoccupied Ukraine gathering evidence. She has said there is a reasonable basis to believe that both war crimes and crimes against humanity have been committed, and in an <a href=\\\"https:\\\/\\\/www.france24.com\\\/en\\\/live-news\\\/20220323-ukraine-prosecutor-probes-war-crimes-in-fog-of-war\\\" target=\\\"_blank\\\">interview with AFP<\\\/a> said that what is happening in the port city of Mariupol is \\u201cnot about war, it\\u2019s about genocide\\u201d. Her office has also launched a new government <a href=\\\"https:\\\/\\\/warcrimes.gov.ua\\\/\\\" target=\\\"_blank\\\">portal<\\\/a> where the public can report war crimes they witness in Ukraine. Venediktova says cases will be prosecuted in Ukraine\\u2019s domestic courts, but the highest prize would be conviction in an international court. She believes there is a strong case for Russians to face charges of war crimes, crimes against humanity and genocide at the <a href=\\\"https:\\\/\\\/www.justiceinfo.net\\\/en\\\/tribunals\\\/icc\\\" target=\\\"_blank\\\">International Criminal Court<\\\/a>, and has also <a href=\\\"https:\\\/\\\/edition.cnn.com\\\/europe\\\/live-news\\\/ukraine-russia-putin-news-03-09-22\\\/h_6563b4eaec09a1336fcb0f74f5f4ed6c\\\" target=\\\"_blank\\\">called for a special tribunal<\\\/a> on war crimes in Ukraine.<\\\/p>\"},\"marker-10\":{\"title\":\"Switzerland: \\u201cActing swiftly and efficiently\\u201d\",\"text\":\"<p>The Office of the Attorney General (OAG) has formed a special unit to identify war crimes being committed in Ukraine. The taskforce will collect evidence from refugees arriving in Switzerland to pass on to the <a href=\\\"https:\\\/\\\/www.justiceinfo.net\\\/en\\\/tribunals\\\/icc\\\" target=\\\"_blank\\\">International Criminal Court<\\\/a>, it said on March 22, adding that it is \\u201cready to act swiftly and efficiently whenever it is necessary\\u201d. New Attorney General Stefan Bl\\u00e4ttler is to head the unit. The OAG was notoriously slow on international crimes under his predecessor. A number of people close to Russian President Vladimir Putin, notably oligarchs, hold assets and own properties in Switzerland and some also have Swiss citizenship.
