27.11.07 - ICTR/MUVUNYI - THE APPEAL HEARING OF MUVUNYI IN FEBRUARY

  Arusha, 27 November 2007 (FH) - The Appeal Chamber of the International Criminal Tribunal for Rwanda (ICTR) is expecting to hear an appeal case in Mid-February of the former lieutenant colonel Tharcisse Muvunyi convicted of genocide and crimes against humanity.

The chamber took that decision in accordance with the proposition stated by the defense and the accused. The prosecutor did not oppose the time suggested by the defense which based the recovery of the lead counsel for Muvunyi who was absent for health reasons.
 
The presiding judge Fauto Pocar ordered an immediate submission of medical report on the part of Mr William Taylor, Muvunyi's lead counsel.
 
Tharcisse Muvunyi, the former high rank of Rwandan Army was sentenced to 12 years imprisonment on12 September 2006 by the first instance chamber after being found guilty of genocide, direct and indirect public incitement to commit genocide and crimes against humanity including rape.
 
Arrested in United Kingdom on 5February 2000, his trial commenced on 28 February2005 and closed on 23June2006 over a period of 78 trial days. The chamber heard a total of 47 witnesses.
