10.09.08 - RWANDA/FRANCE - BIVUGABAGABO'S EXTRADITION TO KIGALI TO BE KNOWN ON 9 OCTOBER

Paris, 10 September 2008 (FH) - The Appeal Court of Toulouse (Haute-Garonne), southern France, will render a decision on 9 October on the extradition request made by Kigali against a former Rwandan soldier, Marcel Bivugabagabo, wanted for his alleged role in the 1994 genocide.

The 53 year-old man, arrested in France early January but on conditional release since 16 July, is on the list of the 93 persons wanted by Rwanda for alleged April-July 1994 killings.

On 22 May, during the last hearing, the investigation chamber of the Appeal Court of Toulouse requested that the Rwandan legal authorities provide documents before rendering a decision on the grounds of the extradition request.

Bivugabagabo filed an appeal to the Final Court of Appeal after the Appeal Court of Toulouse rejected his request for a conditional release. The Final Court of Appeal cancelled this decision and referred the case before the Appeal Court of Pau which approved his release.
