01.07.09 - RWANDA/SWITZERLAND - SWITZERLAND WILL NOT EXTRADITE RWANDAN-GENOCIDE SUSPECT TO KIGALI

Bern, 1 July 2009 (FH) - Switzerland will not extradite a Rwandan national accused in his native country for 1994 genocide and war crimes, reports Hirondelle Agency.

"An extradition to Rwanda is impossible because of the situation which reigns in this country as regards to human rights and the extradition request is not sufficiently supported", stated a Swiss Federal Office of Justice (FOJ) statement.

"However, Rwanda has possibility of presenting to Switzerland a request for the criminal prosecution of the suspect", added the statement, without giving out the name of the Rwandan suspect.

The person was wanted by the Rwandan authorities and was the subject of an arrest warrant on the website of Interpol, according to Bern.

The Rwandan Embassy of Rwanda has already presented to Switzerland a formal extradition request for the suspect, who has resided on its territory since 1995.

The statement also underlines whether the suspect's rights will be fully respected if he were to be transferred to Rwanda.

Western European countries have refused to extradite Rwanda genocide suspects wanted by their country, asserting that the conditions for a free and fair trial were not yet guaranteed.
