1.06.12 - ICC/LIBYA - GADDAFI CAN STAY IN LIBYA PENDING COURT’S DECISION

The Hague, June 1st, 2012 (FH) - A Preliminary chamber of the International Criminal court (ICC) granted Libya the right to postpone its execution of the ICC’s request for surrender of Saif Al-Islam Gaddafi, pending its final determination of Libya’s challenge to the admissibility of the case, dated May 1, 2012. According to the ruling, the accused can stay in Libya while the ICC decides if it has jurisdiction to try him.

An international arrest warrant was issued against Saif al-Islam Gaddafi on June 27, 2011 for war crimes and crimes against humanity. The son of the former dictator was arrested in November but since then, he has been jailed in the remote town Zintan (Libya). The new government submitted a request to try him on its soil on May 1st.

Judges stressed that “the arrest warrant [against Mr Gaddafi] remains valid (…), and accordingly Libya must ensure that all necessary measures are taken during the postponement in order to ensure the possibility of an immediate execution of the Surrender Request should the case be found admissible”.

Libya denied on Friday information according to which Zintan rebels were refusing to hand Gaddafi over to the central government if past-due salaries were not paid.
