11.06.12 - ICTR/FUGITIVES - NTAGANZWA DEFENCE CHALLENGES CASE TRANSFER TO RWANDA

Arusha, June 11, 2012 (FH) – The Duty Counsel for ICTR fugitive Ladislas Ntaganzwa has filed an appeal against the ICTR's decision to transfer his case to Rwanda.

Lawyer Francis Stolla filed the appeal on June 8, but the prosecution asked the court the same day to throw out the appeal on grounds it came too late, prosecutor James Arguin told Hirondelle.

An ICTR Referral Chamber approved transfer of the case to the Rwandan courts on May 8. The appeal should have been filed within 15 days after that, according to the prosecutor's motion.

ICTR Prosecutor Hassan Bubacar Jallow handed the case files over to Rwanda on May 24.

Former Rwandan mayor Ntaganzwa is accused of genocide, crimes against humanity and war crimes. At the time of the 1994 genocide, he was mayor of Nyakizu commune in the southern prefecture of Butare.
