12.11.08 - RWANDA/GACACA - GACACA COURT OVERTURNS 12 YEARS JAIL OF AN ACUSED TO LIFE IN PRISON

Kigali, 12 November 2008 (FH) - Laurent Magambo, accused of crimes of genocide and crimes against humanity, was found guilty of rape at the end of a revision trial and was sentenced Sunday to life in prison by a semi-traditional Gacaca court of Kigali.

In appeal, he had been sentenced to 12 years in prison for other crimes than the rape.

The revision trial was held before gacaca court of Kicukiro, Nyakabanda, the alleged place of incident.

"The court regards him as a renowned killer and an author of rapes and sentences him to life in prison and to civic degradation", declared the president of the court, Alphonse Rugiramimaro.

According to testimonies, the defendant took part in the establishment of lists of people to kill, was charged with the organization of road blocks and maintained day and night rounds. "He closely watched my husband. The day before when they came to get him to kill him, he spent the night knocking at our door and we did not open", testified a woman, charging Magambo with the death of her husband, Charles Ntukanyagwe.

The proceedings concerning the allegations of rape proceeded in closed session.
